Former Supreme Court Judge Abhay S. Oka has made a powerful constitutional clarification — one that directly supports our demand for a year-round nationwide ban on firecrackers.

“Is bursting of firecrackers protected under the right to religion? The answer must be firmly in the negative.”

Speaking at a Supreme Court Bar Association lecture on “Clean Air, Climate Justice, and We,” Justice Oka stated clearly: no religion permits harming the environment or causing cruelty to animals — therefore firecrackers cannot claim protection under Article 25 of the Constitution.

Why Justice Oka’s Words Matter
Justice Oka is one of India’s most respected judicial voices on environmental protection. Known for:

•Strong environmental jurisprudence

•The year-round firecracker ban order in Delhi-NCR.

•Rulings prioritising Article 21: right to life & clean air.

5 Ways This Validates Our Petition:

1. Article 25 Does Not Protect Firecrackers
“I cannot say that on a religious festival I have the right to create pollution.”
•No festival gives anyone the right to pollute.

2. Article 21 Comes First
The right to life and clean air supersedes any practice that endangers public health.
•Firecrackers violate the fundamental rights of millions.

3. Animals Cannot Protect Themselves
“Humans may use ear plugs, but birds and animals cannot. We never think of what happens to them.”
•Every festival season: dogs fleeing in panic, birds collapsing mid-flight, wildlife abandoning habitats.

4. Firecrackers Are Not Essential to Any Religion
They enjoy no constitutional protection.
•This strengthens the case for a year-round nationwide ban.

5. Environmental Protection Is Indian Culture
“For centuries, our religious and philosophers have taught us the importance of preserving our environment… Maybe with time, we have forgotten what is best in our culture.”
•Celebration without harm is authentically Indian — not against tradition.

The Truth Is Simple:
No festival gives anyone the right to poison the air or terrorize animals.

Real celebration doesn’t require explosions — it honors life.

If you believe:
Clean air is a right, sign now.

Animals deserve protection, share now.

India deserves better, act now.

Your signature isn’t just support — it’s proof that compassion is louder than firecrackers!
