

Our Environmental Impact Statement appeal was heard before the Court of Appeals Division I, March 4th, 2026. We're so grateful to our incredible legal counsel and everyone who helped make this happen.
The question at hand was the fairness of the dismissal of our case, which could set precedent. Seattle advertised an appeal process in the Notice of Availability for their Environmental Impact Statement (EIS). Yet, within a few months they declared this exact appeal they advertised was not available to the public and disregarded their own procedures by dismissing valid cases.
When I filed my appeal I used the portal on the hearing examiner page. They did not have an electronic option for payment - the only options were to call or to deliver a check. I opted to call during which time I asked the staffer if I was in the right place and she responded "Yes you are" and proceeded to take my credit card number for payment.

Highlights:
*The City did not follow its own procedures;
*Removing appeals removes of oversight of environmental review - removes the ability for the city to know if they have the best information.
