Benjamin and Kelly have violated the Parenting Plan for over 3 years. After i removed my petition to federal court last August 2024 it remained unresolved for months. Today i filed a motion to dismiss on the grounds that there is a valid Parenting Plan in my divorce case. Judge Suzanne Cook ignored this evidence in favor of proceeding with the fraudulent adoption petition. This is the reason i removed my case under 28 U.S. Code § 1443. My case will establish the grounds to amend TN Code § 36-1-116 (2024). Adoption petitions should never be filed to deprive a another parent to the custody of their child after a former spouse remarries.

I will soon be reunited with my son whom i have been deprived for over 3 years without reason.
