Dear citizens,
Attaching herewith the approval letter given by MCZMA to Mistry Construction dated 11th January 2018 for Golf Course & residential towers.
It shows how mockery has been made of the the entire process of approval.
1. Your attention is invited to Para 3 of the letter which says that CIDCO MD letter of 19th January 2017 denied existence of any wetlands in Pockets A B C D & E of Sector 60 Nerul despite these wetlands forming part of National Wetlands Atlas and protected by Hon'ble Bombay High Court order.
2. The deceit and fraud doesn't stop with this lie but if look at para 5 the PP I.e Mistry Construction submitted BNHS report of 2013 and suppressed the BNHS report of 2017.
3. The BNHS did a 5 year study and gave its final report in March 2017. Copy available on Google.
The report has a disclaimer that "The report has to be used in its totality to achieve its desired goals."
The recommendations are from page 66 to page 74 & pages 75 & 76 lists specific issues of concerns.
Page 75 is reproduced herewith:
Specific Issues of concern
1. Proposed Golf Course
A golf course has been proposed by CIDCO in about 80 ha land at Sector 60 which essentially consists of wetlands behind NRI and TSC (see Figure 51). It is our considered opinion that this is a wetland having all the essential wetland characteristics. This is an extraordinary
wetland that is used by a large number of migratory and resident water birds. On average, around 40,000 to 50,000 birds including 10,000–15,000 Near Threatened Lesser Flamingoscan be observed roosting at this site at high tides during winter season.
We have recommended this site to be declared as protected area in the studies carried out for proposed Navi Mumbai International Airport (NMIA) and Mumbai Trans-Harbour Link (MTHL). Conversion of this land to a different purpose (in this case, a golf course) will seriously jeopardise the air safety of the proposed airport as birds may start using the NMIA and its influence zone for roosting purposes in the absence of the above mentioned wetland.
Under no circumstances should this land be diverted to any other land use.
As submission of this report would have resulted in rejection of proposal this report was suppressed in the process endangering the life's of passengers due to risk of bird hits.
4. As can be seen from above the whole approval is based on lies and is evident from the facts presented above.
Cidco’s officials wanted to handover this land worth 7000 cr. at current market value to benefit a private builder at the cost of destruction of wetlands protected by Supreme Court order. They are even willing to risk the passengers safety to benefit a private builder.
5. In fact they have already given go ahead for construction on a plot worth 810 cr despite the matter being pending before Supreme Court on the basis of SLP filed by CIDCO and Mistry Construction. This needs to be stopped immediately.
6. This is highly suspicious and needs to be investigated throughly.
You are requested to please intervene & do the needful.
