Good Evening Petition Supporters,
Thank you for your patience throughout this journey. We have been waiting for official documentation from the County on the court’s probation terms for the owner of 1840 Mason Mill Rd. Below please find details of probation. In addition, the community remains committed to monitoring terms of the probation and reporting any DeKalb County Ordinance Code violations. On 01/20/2017, approximately 30 Mason Mill residents attended a hearing in DeKalb County Magistrate Court in support of the enforcement of DeKalb County Ordinance Codes for the residential property located at 1840 Mason Mill Road.
Verdict: Magistrate Judge Matthew McCoyd found the owner of 1840 Mason Mill Road guilty on 10 counts of signage code violations.
Sentence: The Judge sentenced the Defendant to 1 week in County jail immediately following the hearing; pay $10,000 in fines; and serve 60 months probation.
Terms of Probation: 6 month probation for each of the 10 citations to run consecutive, and concurrent to each other as set forth below. The length of the sentence shall be from January 20, 2017 until June 5, 2020. As a special condition of probation, the Defendant must not violate any provisions of the DeKalb County Ordinance Code. The Defendant is fined $10,000; but for each probationary term that the Defendant’s property is in compliance with the provisions of the DeKalb County Ordinance Code, $1,000 of the fine is suspended.
The court will conduct hearings to determine if the property is in compliance as follows:
-02/28/17-if NOT compliant $1000 not suspended, Defendant serves 14 days in custody;
-04/18/17-if NOT compliant $1000 not suspended, Defendant serves 21 days in custody;
-06/13/17-if NOT compliant $1000 not suspended, Defendant serves 30 days in custody;
-08/15/17-if NOT compliant $1000 not suspended, Defendant serves 30 days in custody;
-10/17/17- if NOT compliant $1000 not suspended, Defendant serves 30 days in custody;
-12/19/17- if NOT compliant $1000 not suspended, Defendant serves 30 days in custody;
-02/20/18- if NOT compliant $1000 not suspended, Defendant serves 60 days in custody;
-05/22/18- if NOT compliant $1000 not suspended, Defendant serves 60 days in custody;
-08/21/18- if NOT compliant $1000 not suspended, Defendant serves 60 days in custody;
-11/27/18- if NOT compliant $1000 not suspended, Defendant serves 60 days in custody;
-03/05/19- if NOT compliant, Defendant serves remaining 402 days in custody.
Each time following release from custody, the Defendant has 30 days to bring his property into compliance with the DeKalb County Ordinance Code.
