【概要】

起業家業界ではセクハラや性犯罪が起きており、性犯罪を受けた人が声をあげられずに来た現状があります。特にスタートアップ業界ではセクハラや性犯罪問題が顕著です。

今回、未来の起業家が安心して起業できる環境づくりのために署名の立ち上げを始めました。

 

【経緯】

スタートアップ起業をしようと業界に片足を踏み入れた時、セクハラ、性犯罪が当然のように行われていることに驚きました。投資をちらつかせながらセクハラや性犯罪を繰り返している方が多く、業界に絶望をしました。

私自身も性被害に遭いました。「投資をするよ」と言われて会いに行ったら、仕事の話はなく、去り際にキスをされたり、オフィスだと言われて行ってみたら実は普段使われていない自宅兼オフィスで社員もおらずレイプされたりしました。さらに声をあげられることを恐れたのか、隠蔽のために深刻な嫌がらせも始まり、起業家業界にいることができなくなりました。

そのため長年の夢だった起業を諦めざるを得ない状況になりました。

私がセクハラ・性被害を告発するに至った理由は、このままなかった事にして放置をすることは簡単ですが、それでは同じような被害者を出し続けてしまう、と危機感を持ったからです。また、このままでは日本において優秀な起業家を安心して排出する環境を築けないと思いました。

起業家の中でも特にスタートアップ業界のジェンダーギャップが大きいと言われています。男性が過半数を超える男子校のような社会の中で、セクハラは多く、スタートアップの資金調達額は女性がたったの2%と言われています。

こうした被害に遭ってきたのは私だけではなく業界全体の問題です。メディアでも取り上げられてきましたが、まだまだ認知が少なく、問題は山積しています。

【問題点】

▼セクハラや性犯罪はどこで起きているのか

（１）起業家と投資家、VC（２）起業家と起業家　（３）起業家とメンター が問題視をされています。

投資する側が圧倒的に権力を持っており、資金集めをしようとする起業家がどんな被害に遭っても声を潰されることが起きてきました。また起業家業界は世界が狭く、投資家に逆らうと起業できないという圧力、逆らうと起業家コミュニティから排除されるということも起きてきました。

▼起きている具体的な事例

（１）起業家と投資家、VC

一生懸命事業計画書を作って見せに行っても、「まともに仕事の話を聞いてくれた人は10人会って1〜2人程度だった」という声、「愛人になってくれたら毎月100万円振り込む」などのセクハラ被害の声もあります。これではどれだけ努力をしてもビジネスは進展せず疲弊をする一方です。

また投資後に投資家からセクハラを受けて逃げ場がなくなった人の声も聞きます。 セクハラを受けながら誰にも相談する場所もなく、投資家にセクハラをやめさせる手立てもないのであれば、これは深刻な人権侵害の放置です。早急な法改正が必要です。

（２）起業家と起業家

「性行為をしないのなら、取引をやめる」などと脅されることもあります。セクハラ問題に関して「性行為を断ればいいではないか」という人もいるかもしれませんが、単に断って解決する問題ではなく、それによってビジネス上の損害が起こることもあります。

（３）起業家イベント

起業家が集まるイベントでは同質性の高い人や加害者が登壇をしていることも多く、ハラスメントが起きやすい環境です。ハラスメントを報告しても取り合ってもらえないことがほとんどです。また、起業家のイベントはピッチコンテストなど巨額のお金が動くこともあり、大事なビジネスの機会でもあり不正は許されません。

 

現状の法律では起業家・投資家・VCで行われるハラスメントは、法律の落とし穴です。とはいえ、放置していい問題ではありません。前述の事例の通り多くの起業家が悩んできたのは間違いありません。

私たちは未来の起業家が少しでも安心して働けるように、私のように絶望する人がいないように、署名を集めることにしました。

 

【ゴール】

起業家・投資家・VCにおける取引きは労働者扱いにならずセクハラがあっても法律で取締ることができずにいました。

そうした問題がないような法律の制定を要請します。

※追記

セクハラや性犯罪は起業家業界で起きた出来事であり、起業家の環境整備を考えるきっかけとなりました。しかし社会問題としてハラスメントそのものの法律制定も必要であり、下記の二軸での法制定を目指しています。

（１）起業家新法

フリーランス新法に倣い、労働者扱いとならない起業家に対してのハラスメントの撲滅や相談窓口の設置、起業家の働き方など業界改善を要請するもの。また、起業家が労働者扱いにならないことによる育休の不整備などその他の起業家の増加・成長の妨げになっている要因についても一緒に見直します。

（２）ハラスメント法の制定

ハラスメントそのものの法律制定を目指す。就活セクハラやフリーランスのハラスメント、芸能界へのハラスメントなどハラスメントが絶えません。業界を限定せず、ハラスメントそのものに対して法律制定を行わないと、加害者への罰則や被害者への救済を行うことができません。海外ではハラスメントそのものを罰する法律があり、日本にも必要です。起業家業界の目線でいうと、資金が十分にある起業家や投資家は民法で定められた損害賠償金は端金であり、示談金を払われ隠蔽されてしまうケースが多々あります。抑止力のある、罰則が必要です。

Overview
Sexual harassment and assault have occurred in the entrepreneurial community in Japan, and many victims—especially women—have been unable to speak out. The problem is particularly pronounced in the startup industry.

This petition was launched to create an environment where future entrepreneurs can start their businesses safely and with peace of mind.

 
Background
When I first stepped into the startup world with the dream of becoming an entrepreneur, I was shocked to find that sexual harassment and even sexual assault were treated as commonplace. I witnessed many individuals using the lure of investment to repeatedly commit such acts, and I quickly became disillusioned with the industry.

I, too, was a victim of sexual violence. I was told, “I’ll invest in your business,” and when I went to meet the investor, there was no business discussion—only an unsolicited kiss. On another occasion, I was told to come to an “office,” which turned out to be a rarely-used apartment with no employees. There, I was raped. Later, I was subjected to harassment aimed at silencing me and forcing me out of the entrepreneurial community altogether.

Eventually, I had to give up on the long-held dream of launching my own business.

I chose to speak out about the harassment and assault I experienced because I could not allow this to be swept under the rug. I feared that remaining silent would enable future abuse and discourage more women from becoming entrepreneurs. I also believe that unless this issue is addressed, Japan will not be able to foster an ecosystem where talented entrepreneurs can thrive safely.

 
The Issue
The startup world has long been described as having a severe gender gap. It is often likened to an all-boys club, where sexual harassment is rampant. Women receive only about 2% of total startup funding. This is not just my personal experience—it is a structural problem affecting the entire industry.

Media coverage on this issue has increased, but public awareness remains limited, and serious challenges persist.

Specific Problems

Between entrepreneurs and investors/VCs
Between entrepreneurs themselves
Between entrepreneurs and mentors
Investors hold overwhelming power, and entrepreneurs seeking funding have often been silenced even when subjected to abuse. The startup community is small, and resisting a powerful investor can mean being excluded from the ecosystem entirely.

Entrepreneurs and Investors/VCs
Even after crafting detailed business plans, some women report that only 1 or 2 out of 10 investors actually engaged with them professionally. Others have been told, “Become my mistress, and I’ll wire you ¥1 million every month.” Such harassment drains entrepreneurs of energy and stalls their business progress.
There are also reports of women who faced harassment after receiving investment, leaving them trapped without any support or way to stop the abuse. This is a grave human rights issue that requires urgent legal reform.
Entrepreneurs and Other Entrepreneurs
Some have been threatened: “If you won’t sleep with me, the deal’s off.” While some may say, “You can just say no,” rejecting such advances can result in serious business losses.
Startup Events
Startup events often feature perpetrators or create environments where harassment is more likely to occur. Reports of abuse are typically ignored. Since these events often involve pitch contests with large financial stakes, fairness and safety are essential.
 
Currently, there are legal gaps that leave harassment between entrepreneurs, investors, and VCs unaddressed. But this issue cannot be ignored. Many have suffered in silence, and it’s time for change.

We are gathering signatures to ensure that no future entrepreneur has to feel the same despair I did, and so that everyone can work in a safer, fairer ecosystem.

 
Our Goal
Transactions between entrepreneurs, investors, and VCs do not fall under traditional labor protections, so existing sexual harassment laws do not apply.

We are calling for new legislation to close this gap and prevent further abuse.

We must eradicate sexual harassment and assault from the entrepreneurial ecosystem and protect the next generation of leaders.
