【現実に起きていること】
 最近の報道でも、公益通報者(又は公益通報者に該当する可能性のある内部告発者)が命を絶つ痛ましい事例が相次いでいます。
①和歌山市では、不正を通報した職員が復職後、同じ職場で通報対象者と再び働かされ、自ら命を絶ちました。報道1
②兵庫県では、知事の行動を通報した職員が停職処分を受け、その後、自殺しました。報道2 
 不正を正そうとする勇気ある行動が、命やキャリアを奪う結果になっています。

  【公益通報の内容:贈収賄事件と患者の個人情報漏洩】
私が外資系医療機器販売企業に勤務していた際、会社が手術動画キャンペーン、ビデオキャンペーンというプロモーションを行っていました。
会社が全国の複数の眼科医と、会社のレンズを使った白内障手術の動画を作成する契約を結び、商品を優先的に購入してもらう見返りに、医師から動画の提供を受けたうえで、現金をドクターに支払っていました。
2022年7月、医療機器業公正取引協議会の調査の結果、現金を渡した医師は75人で総額は2,145万円に上ることが明らかになりました。
公正取引協議会は、動画は、医師に現金を提供するための名目で、実際には、販売促進が目的だったと認定し、最も重い処分である「厳重警告」としました。
 
私は、次の二つの重大な問題を確認していました。
一つは、医師に対する不適切な金銭提供、いわゆる贈賄の疑いです。
もう一つは、患者の手術動画など、個人情報の管理に重大な不備があることでした。私は、これらは見過ごしてはいけない問題だと考え、警察および個人情報保護委員会に対し、公益通報を行いました。

その結果、大阪府警の捜査で、2023年、奈良県の大和高田市立病院に勤務していた眼科医が、収賄罪で懲役1年6か月、執行猶予3年の有罪判決を受けました。また、会社の代表社員2名を含む4名が贈賄罪で罰金の略式命令を受けています。
さらに、患者の個人情報の問題については、個人情報保護委員会からA社と60の病院に行政指導が行われました。個人情報保護委員会の調査の対象となった全国60の医療機関すべてで、①患者の同意を得ずにメーカーに動画を提供したり、②医療機関側が動画の提供を把握していなかったりするなどの問題があったということで、一斉に注意喚起を行うなどの行政指導をしました。このうち11の医療機関については、個人が特定されるリスクが比較的高い状態だったなどとして、A社とともに個人情報保護法に基づく指導を行ったということです。
つまり、私が通報した内容は、結果として事実であり、刑事責任や行政責任が認められる問題でした。

【公益通報したら5,120万円を請求されました】
 しかし私は、その後、「報道機関にも情報を提供した」などという理由で解雇され、さらに、会社から約4,788万円もの損害賠償請求訴訟を起こされました。会社はその訴訟を起こすのと同時に、私の預金の大半を仮差し押さえする手続きを取り、私の知らぬ間に執行されました。
会社からの訴状に記載されていた請求の内訳は、 
①病院との契約解除により逸失利益として少くとも1,225万4,000円の損害 ②個人データの漏洩の調査等の対応に関する従業員の残業代162万7500円 
③事実調査・個人情報保護委員会への報告等調査のために弁護士費用として少なくとも400万円  
 以上 17,881,500円が2024年2月に請求され、このうち大部分の金額が私の複数の預金口座から裁判所に仮差し押さえとなりました。
 後に、「訴状」が裁判所より届きました。そこには、
「会社の信用が毀損されたこと等により3,000万円の無形損害が発生」 
が追加され、訴状の合計はなんと4,788万1,500円に増加していました。
 さらに、2022年3月22日を起点とした年間3%の遅延利息3,321,533円も同時に請求され。すべて含めると、5,120万3,033円になりました。

【報復訴訟による深刻なダメージ】
ストレスから拒食と過食を繰り返すようになりました。鬱状態に陥ったこともあり、1週間ほど食事をとることができなくなったこともありました。この訴訟のことを知った身内も、ストレスで1週間仕事を休んでしまったほどでした。本人だけではなく周りの人たちにも深刻な影響がでてしまい、そのことが悔やまれるとともに、会社に対して強い憤りを感じました。

【1審判決(勝訴) 2025年12月19日】
  2025年12月19日、東京地裁の判決では、中村心裁判官は、情報の持ち出しは公益通報のための行為で、違法ではないと判断し、会社の請求を棄却しました。
判決は、報道機関への情報提供は認められないとしたうえで、情報を持ち出したのは、警察などへの通報のためだったと指摘しました。
持ち出した情報は会社の犯罪と関係ないものも含んでいましたが、判決は「捜査機関は情報の信用性を判断するため、容疑の周辺の情報も必要とするもので、どの程度の情報を求められるかを通報者が認識するのは難しい。無関係な情報の持ち出しのみを切り取って違法だとは認められない」と結論づけました。
 企業や行政などの不正を内部告発した人を守るための公益通報者保護法は、通報によって損害が生じたことを理由に、通報者を訴えることを禁じています。一方、私の例のように、通報の前提となる内部資料の持ち出しへの提訴は禁止されていません。
公益通報者保護法は、2024年の改正で、公益通報者をより確実に保護するため、通報を理由とした解雇や懲戒処分への罰則などを導入しました。この改正を議論した有識者検討会では、通報のための資料収集や持ち出しに関する民事や刑事上の免責規定が必要だとする意見もでましたが、「企業情報の漏洩リスクが高まる」などとして見送られました。
過去にも、企業などが不祥事を内部告発した通報者に対し、「機密書類を無断で持ち出した」として損害賠償請求を起こした例があります。持ち出しの違法性を認めなかった裁判例はありますが、組織から訴えられるリスクは、内部告発をためらわせることにつながりかねません。
日本弁護士連合会は24年の意見書で「通報の裏付けとなる資料を集めることへの損害賠償請求を制限する規程を設けるべきだ」と主張しています。

【会社は控訴!!!】
2025年12月26日付で、会社は控訴しました。東京高等裁判所において、2026年6月4日、第1回期日で即日結審されました。

  【なぜ法改正が必要なのか】 
私の通報は実際に刑事事件に発展し、有罪判決や略式起訴につながった正当な公益通報です。
それにもかかわらず、通報者が逆に報復訴訟の標的となり、甚大な被害を受けるという現実は、日本における公益通報制度の重大な欠陥を示しています。
欧米では「SLAPP訴訟(恫喝訴訟)」を防ぐ制度が整備されつつありますが、日本では有効な規制が存在せず、企業による高額訴訟が事実上野放しとなっています。
この現状を放置すれば、「もう通報なんてしない方がいい」という空気が社会全体に広がり、不正が隠蔽され、命や安全が犠牲になり続けます。

【私たちが求める法改正】
公益通報者保護法に、次の仕組みを加えてください。
①SLAPP訴訟を防ぐための制度導入(不当訴訟の早期棄却) 
②報復行為の「推定規定」を設ける(状況証拠で認定可能に) 
③報復行為を行った企業とその代表者・担当者に対する厳罰処分 
④通報者への法的・経済的支援制度の整備(弁護士費用・生活支援)

公益通報者保護法は何度か法改正を経ていますが、十分に機能していません。
 制度を実効的なものにするには、市民の声が欠かせません。

  🔹Whistleblowing Report: Bribery Scheme and Leakage of Patients' Personal Information
While I was employed by a multinational medical device company, the company conducted a marketing initiative known as the "Surgical Video Campaign" (also referred to as the "Video Campaign").
Under this program, the company entered into agreements with numerous ophthalmologists across Japan to create videos of cataract surgeries performed using the company's intraocular lenses. In exchange for giving preferential consideration to the company's products, the company obtained these surgical videos from the physicians and paid them cash compensation.
In July 2022, an investigation by the Fair Competition Code Council of the Medical Devices Industry revealed that 75 physicians had received cash payments totaling 21.45 million yen (approximately US$180,000 at the time).
The Council concluded that the video production program served merely as a pretext for providing cash to physicians and that its true purpose was to promote sales of the company's products. As a result, the company received the Council's most severe disciplinary sanction: a "Strict Warning."
I identified two serious issues with this program.
The first was the suspected provision of improper financial benefits to physicians, amounting to alleged bribery.
The second was the company's serious failure to properly manage patients' personal information, including surgical videos containing patient data.
Believing that these were serious violations that could not be ignored, I submitted whistleblower reports to both the Japanese police and the Personal Information Protection Commission (PPC).
As a result of the Osaka Prefectural Police investigation, in 2023 an ophthalmologist employed by Yamato Takada Municipal Hospital in Nara Prefecture was convicted of accepting bribes and sentenced to one year and six months' imprisonment, suspended for three years. In addition, four individuals, including two representative executives of the company, received summary fines for bribery offenses.
With respect to the personal information issues, the Personal Information Protection Commission (PPC) issued administrative guidance to the company and 60 medical institutions.
According to the PPC's investigation, all 60 medical institutions examined had problems, including:
1. Providing surgical videos containing patients' personal information to the manufacturer without obtaining the patients' consent; and
2. Situations in which the medical institutions themselves were unaware that such videos had been provided to the manufacturer.
As a result, the PPC issued nationwide administrative guidance requiring corrective measures and raising awareness among the affected institutions.
Furthermore, with respect to 11 of those medical institutions, the PPC determined that the risk of identifying individual patients was relatively high and therefore issued formal administrative guidance to both the company and those institutions pursuant to the Act on the Protection of Personal Information (APPI).
In other words, the matters I reported as a whistleblower were ultimately confirmed to be true. The investigations resulted in findings of both criminal liability and administrative violations, demonstrating that my whistleblowing exposed genuine and serious misconduct.
 
🔹I Was Sued for ¥51.2 Million (Approx. US$402,230) After Blowing the Whistle
However, after making my whistleblower reports, I was dismissed from my job on the grounds that I had also provided information to the media.
The company then filed a civil lawsuit against me, seeking approximately ¥47.88 million (about US$402,200) in damages.
At the same time it filed the lawsuit, the company also applied for and obtained a provisional attachment (pre-judgment asset freeze) over most of my personal savings.
The attachment was executed without any prior notice to me, and I did not become aware of it until after my bank accounts had already been frozen.
As a result, I was forced to defend myself not only against the company's lawsuit but also against the sudden freezing of my personal assets, despite the fact that my whistleblowing ultimately led to criminal convictions and administrative enforcement actions against the company and those involved.
 
 The damages claimed by the company are broken down as follows:
 1. Alleged lost profits resulting from the termination of contracts with hospitals:At least JPY 12,254,000 (US$102,940)
 2. Overtime wages allegedly incurred by employees in responding to and investigating the alleged leakage of personal data:JPY 1,627,500 (US$13,672).
 3. Legal fees related to fact-finding investigations and reporting to the Personal Information Protection Commission:At least JPY 4,000,000 (US$33,602).
 In February 2024, a total of JPY 17,881,500 (US$150,214) was initially demanded. The majority of this amount was provisionally seized by court order from multiple bank accounts held in my name.
 Subsequently, I received a formal statement of claim from the court. This document added an additional claim of JPY 30,000,000 (US$252,016) in alleged non-material (intangible) damages, citing harm to the company’s reputation. As a result, the total amount claimed increased to JPY 47,881,500 (US$402,230).
 In addition, the company claimed statutory delay interest at an annual rate of 3%, calculated from 22 March 2022, amounting to JPY 3,321,533 (US$27,903). When all amounts are combined, the total damages claim reached JPY 51,203,033 (US$430,133).
 
🔹Severe Damages Caused by SLAPP lawsuit
 As a result of extreme stress, I began to experience disordered eating, repeatedly alternating between loss of appetite and overeating.
At times, I fell into a depressive state and was unable to eat properly for approximately one week.
 This retaliatory lawsuit has caused serious damages not only to the whistleblower but also to those around them. I deeply regret the suffering inflicted on my family and feel profound anger toward the company responsible.
 
🔹First-Instance Judgment (December 19,2025)
  On 19 December 2025, the Tokyo District Court ruled in favor of the whistleblower. Presiding Judge Shin Nakamura held that the removal of information constituted an act undertaken for the purpose of whistleblowing and was not unlawful, and therefore dismissed the company’s claims.
  While the court stated that the provision of information to media organizations was not permissible, it found that the information had been taken for the purpose of reporting to law enforcement authorities, including the police.Although some of the information taken did not directly relate to the company’s criminal conduct, the court concluded as follows: “Investigative authorities require surrounding and contextual information in order to assess the credibility of allegations. It is difficult for a whistleblower to determine in advance the precise scope of information that will be required. Therefore, the mere inclusion of information unrelated to the alleged offense cannot, by itself, be deemed unlawful.”
 
🔹Appeal Filed by the Company
 On 26 December 2025, the company filed an appeal against the first-instance judgment.
The appeal was heard by the Tokyo High Court, where the first hearing was held on June 4, 2026. The court concluded the proceedings on the same day, with no further hearings scheduled.

🔹Why Legal Reform Is Necessary
 My whistleblower report was legitimate and made in the public interest. It led to a criminal investigation and ultimately resulted in criminal convictions and summary indictments.
  Despite this, the reality in Japan is that whistleblowers are instead targeted by retaliatory lawsuits and subjected to severe personal, professional, and financial harm. This demonstrates a fundamental and serious flaw in Japan’s whistleblower protection framework.
  In Europe and the United States, legal mechanisms to prevent Strategic Lawsuits Against Public Participation (SLAPPs) are increasingly being developed and implemented. In contrast, Japan lacks effective regulations to prevent such abusive litigation, allowing companies to file excessive and punitive lawsuits with little restraint.
  If this situation is allowed to continue, a chilling effect will spread throughout society—creating an atmosphere in which people feel that “it is better not to report wrongdoing at all.” As a result, misconduct will be concealed, and lives, safety, and the public interest will continue to be sacrificed.
 
🔹Legal Reforms We Are Calling For
 We call for the following mechanisms to be incorporated into Japan’s Whistleblower Protection Act:
 1. Introduction of measures to prevent SLAPPs, including procedures for the early dismissal of abusive or unfounded lawsuits intended to retaliate against whistleblowers.
 2. Establishment of a legal presumption of retaliation, allowing retaliatory acts to be recognized based on circumstantial evidence, once a whistleblower has engaged in protected reporting.
 3. Imposition of strict penalties on companies and their executives or responsible individuals who engage in retaliatory actions against whistleblowers.
 4. Development of comprehensive legal and financial support systems for whistleblowers, including coverage of legal fees and livelihood support during and after legal proceedings.
