ในปัจจุบันการตายและการบาดเจ็บจากอุบัติเหตุบนทางม้าลายมีมากกว่า 500 รายต่อปี และอัตราการเสียชีวิตสูงถึงร้อยละ 55 แต่ที่ผ่านมา ปัญหานี้ยังไม่ได้รับการแก้ไขอย่างเป็นรูปธรรม จนเกิดเหตุการณ์อันน่าเศร้ากับหลายๆครอบครัว รวมทั้งเหตุการณ์ล่าสุด ซึ่งเกิดขึ้นกับ พญ.วราลัคน์ สุภวัตรจริยากุล หรือหมอกระต่าย --เพื่อนรักของพวกเรา-- ที่เสียชีวิตจากถูกรถจักรยานยนต์ชนในขณะข้ามทางม้าลาย 

ปัญหาทางม้าลายแก้ได้ด้วย 

"ทางม้าลายปลอดภัย-หยุดรถให้คนข้าม-บังคับใช้กฏหมาย-ปรับบทลงโทษ"

พวกเราขอยื่นข้อเรียกร้องแก่รัฐ และหน่วยงานที่เกี่ยวข้องดังนี้

1. ทางม้าลายต้องปลอดภัย: 
รัฐและหน่วยงานที่เกี่ยวข้องต้องออกแบบทุกทางม้าลายเป็นทางข้ามที่ปลอดภัยสำหรับทุกคน เช่น ทางข้ามมีความชัดเจนเห็นได้ในระยะไกล มีป้ายเตือนล่วงหน้าที่ชัดเจนให้ผู้ขับขี่รับรู้ว่าเป็นทางข้าม หากเป็นทางที่มีคนข้ามเป็นประจำหรือเป็นสถานที่สำคัญ เช่น โรงเรียน ต้องมีสัญญาณไฟจราจรรวมถึงมีปุ่มกดเพื่อขอข้าม มีกล้องวงจรปิดในบริเวณทางข้ามที่มักมีการกระทำผิดบ่อยเพื่อบันทึกผู้กระทำความผิดและลงโทษอย่างจริงจัง เป็นต้น
2. หยุดรถให้คนข้าม: รัฐและหน่วยงานที่เกี่ยวข้องต้องเริ่มรณรงค์ให้ประชาชนทุกคนเข้าใจความสำคัญของการหยุดรถให้คนข้ามทางม้าลาย และให้ประชาชนทุกคนเห็นว่าเรื่องนี้เป็นมาตรฐานที่ต้องปฏิบัติตามเป็นประจำ และทำการรณรงค์ต่อเนื่องเป็นประจำและสม่ำเสมอ
3. บังคับใช้กฎหมาย
: รัฐและตำรวจต้องบังคับใช้กฎหมายที่มีอยู่เดิมและลงโทษอย่างจริงจัง กรณีผู้ขับขี่ไม่ลดความเร็วขณะขับรถเข้าใกล้ทางม้าลาย และกรณีไม่หยุดรถให้คนข้ามทางม้าลาย
4. ออกกฎหมายใหม่
: แยกเป็นมาตราใหม่ในพระราชบัญญัติจราจรทางบก ที่กำหนดให้ชัดเจนว่ากรณีผู้ขับขี่ไม่ลดความเร็วรถขณะขับรถเข้าใกล้ทางม้าลาย และกรณีไม่หยุดรถให้คนข้ามทางม้าลายมีความผิด และมีโทษอื่นนอกเหนือจากการปรับ เช่น ตัดคะแนน หรือบังคับให้เข้ารับการอบรม หรือ ยึดพาหนะ
5. ปรับบทลงโทษ
: ออกกฎหมายเป็นมาตราใหม่ในพระราชบัญญัติจราจรทางบก ที่กำหนดบทลงโทษอย่างรุนแรงกับผู้ขับขี่ที่ขับชนคนข้ามทางม้าลาย ในลักษณะคล้ายกรณีผู้ขับขี่เมาแล้วขับชนคนอื่นตามมาตรา 160 ตรี ของพระราชบัญญัติจราจรทางบก ซึ่งมีโทษสูงสุดคือจำคุก และเพิกถอนใบอนุญาตขับขี่ 

อุบัติเหตุต่อคนข้ามทางม้าลายเป็นปัญหาที่มีหลายสาเหตุและเรื้อรังมาเป็นเวลานาน ทั้งจากผู้ขับขี่ที่ไม่ปฏิบัติตามกฏจราจร เพราะไม่ทราบข้อกฏหมายหรือคิดว่าโทษมีน้อย หรือการบังคับใช้กฏหมายไม่จริงจังพอ ดังนั้น ควรมีการบังคับใช้กฏหมายอย่างจริงจัง แก้ไขกฏหมายบางข้อ และรณรงค์เพื่อปลูกฝังจิตสำนึกในการขับขี่

พวกเราอยากให้เหตุอันน่าเศร้าใจของคุณหมอกระต่าย เป็นแรงผลักดันให้มีการเปลี่ยนแปลงของสังคมในเรื่องนี้ เราไม่อยากพบคนที่เสียชีวิตจากเหตุเดียวกันแบบนี้ในไทยอีก

Pedestrians should not live in fear. Zebra crossings must be safe for everyone.

At present, there are over 500 pedestrian accidents on zebra crossings per year with a fatality rate of 55%. However, the government has not made an effort to find a concrete solution to the problem even after the recent death of WARALUCK SUPAWATJARIYAKUL, MD or doctor Kratai (rabbit in English), our beloved friend. She passed away after being hit by a motorcycle while walking across a zebra crossing. She and her family are just one of many who have suffered due to poorly planned infrastructure and inaction by the authorities. The severity of the problem is a cause for immediate action to be taken as thousands of people, both young and old, are crossing these roads on a daily basis.

Our demands to the government and all the relevant authorities are as follows:

1. Zebra crossings must be safe for pedestrians: The Thai government and all relevant authorities must implement a crosswalk design that is clearly visible to motorists and motorcyclists from a distance. In addition, warning signs must be put up urging drivers to slow down before reaching the zebra crossing. Zebra crossings in high pedestrian areas, such as schools, parks, and hospitals, must have traffic lights and CCTV cameras installed. This will not only protect pedestrians, but also will catch individuals who break the law.

2. Cars must stop to allow pedestrians to cross: The government and relevant authorities must start campaigning to enforce the importance of adhering to the speed limit and stopping at crosswalks to allow pedestrians to pass. This standard must be adhered to on a regular basis.

3. The law must be enforced: The government and relevant authorities must enforce existing laws and severely penalize those who do not abide by said laws. Wrongdoers in this case would be drivers or riders who don’t decelerate their vehicles before a zebra crossing and do not stop their vehicles at crossings for pedestrians to pass.

4. New legislation: The government must launch a new legislation in The Land Traffic Act that clearly states that in the event that a driver or rider does not reduce their speed while driving near a crosswalk or stop their vehicle for pedestrians to pass, they will be found guilty and punished. In addition to a fine, such individuals will have points added to their driving license and will be forced to attend a driver education program, or have their vehicle seized.

5. Penalty adjustment: The government must launch legislation in The Land Traffic Act that imposes severe penalties on drivers or riders who crash into pedestrians on a zebra crossing. Under the new legislation, such an individual should receive equal punishment to an intoxicated driver colliding with a pedestrian under section 160 of The Land Traffic Act, which is imprisonment and the seizing of their driving license.

Accidents to pedestrians on zebra crossings have remained an unresolved problem for far too long. Most road users ignore the rules because the penalties are not being enforced, or they are simply not aware of these rules to begin with. The only way to combat this is by increasing the severity of said penalties, strict and fair enforcement of the law, and creating a growing awareness of the importance of following traffic rules. The goal now should be to make zebra crossings in Thailand as safe as in developed countries that give pedestrians the right of way.

We hope the tragedy that happened to doctor Kratai will be powerful enough to make a change. Future accidents involving pedestrians on zebra crossings are unacceptable and should be an avoidable tragedy.
