The Issue

Establish an Independent National Oversight and Accountability System to Uphold the Constitution, Rule of Law, Transparency, and Equal Accountability in Pakistan

🇵🇰 Petition for Constitutional Supremacy, Rule of Law, Transparency, and Equal Accountability in Pakistan

Establish an Independent National Oversight and Accountability System to Uphold the Constitution, Rule of Law, Transparency, and Equal Accountability in Pakistan

Introduction

The people of Pakistan deserve a system in which the Constitution stands supreme, the law applies equally to everyone, public authority is treated as a trust, and no individual or institution is above the law.

We call upon the Government of Pakistan, Parliament, and all relevant constitutional institutions to begin a serious national process for establishing a strong, independent, non-political, transparent, and constitutionally accountable National Oversight and Accountability System.

This petition is not against any individual, political party, the military, judiciary, police, government institution, or any particular state organization.

It is a call for institutional reform, stronger checks and balances, transparency, accountability, justice, and the protection of the public interest.

Our Key Proposals

1. Establish an Independent National Constitutional Oversight Council

Pakistan should establish, through the Constitution, an independent national oversight body whose members are selected on the basis of integrity, competence, constitutional and legal knowledge, professional experience, and public trust.

The members should be protected from political influence, conflicts of interest, and interference by any government, political party, or powerful interest group.

Its powers, limitations, appointment process, financial independence, and accountability must be clearly defined by the Constitution and law.

2. No Individual or Institution Should Be Above the Law

A fundamental principle must be established and protected:

No person, office, or institution is above the Constitution and the law.

The President, Prime Minister, ministers, members of Parliament, judges, civil servants, police officers, members of the armed forces, intelligence officials, and all other public officials should remain accountable within their constitutional and legal responsibilities.

This principle is not intended to weaken any institution.

It is intended to strengthen public trust in every institution.

3. Effective Constitutional Review of Legislation

Parliament is the representative institution of the people and has a fundamental constitutional role in legislation.

However, every law must remain consistent with the Constitution and fundamental rights.

Pakistan should therefore strengthen mechanisms for constitutional review of important legislation and ensure that constitutional disputes can be resolved promptly, independently, transparently, and through the appropriate constitutional forum.

4. Judicial Independence Alongside Accountability

An independent judiciary is essential for democracy, justice, and the protection of fundamental rights.

At the same time, there must be a fair, transparent, evidence-based, and constitutionally established mechanism for addressing credible allegations of corruption, serious misconduct, conflicts of interest, or abuse of authority involving judges.

No judge or citizen should be treated as guilty merely because an allegation has been made.

Investigations must be based on evidence, due process, and law.

Where wrongdoing is proven, appropriate legal action should follow.

5. Independent Oversight of Police and Law-Enforcement Agencies

Pakistan should establish an effective and independent complaints and oversight mechanism for police and other law-enforcement agencies.

This system should address credible allegations involving bribery, political interference, abuse of authority, unlawful detention, mistreatment, or violations of citizens’ fundamental rights.

Every citizen should have a meaningful way to seek justice without needing political influence or personal connections.

6. Constitutional Accountability and Oversight of National Security Institutions

Pakistan’s Army, Navy, and Air Force play an important role in protecting the country’s sovereignty and national security, and their service should be respected.

At the same time, a constitutional democracy requires appropriate legal and parliamentary oversight of the exercise of state power.

Such oversight should protect both national security and constitutional governance.

7. Legal Oversight of Intelligence Agencies

Pakistan’s intelligence agencies have important responsibilities relating to national security.

However, their powers and activities should operate within clearly defined legal boundaries and appropriate constitutional oversight.

Sensitive national-security information must remain protected, while appropriate oversight bodies should receive the information necessary to perform their lawful oversight responsibilities.

8. Zero Tolerance for Proven Corruption and Abuse of Power

Corruption should not be treated as a problem belonging to only one political party, institution, or group.

Where credible evidence exists of bribery, corruption, misuse of public resources, abuse of authority, conflicts of interest, or other unlawful conduct, the matter should be investigated impartially.

If wrongdoing is proven, the law should apply regardless of the person’s position, political affiliation, wealth, influence, or institution.

9. Accountability Must Never Become Political Revenge

Accountability should never become a tool for targeting political opponents or settling personal or political disputes.

Every person must have the right to:

fair investigation;
evidence-based proceedings;
legal representation;
a meaningful opportunity to be heard;
due process; and
the right to appeal where provided by law.
Accountability without fairness can itself become injustice.

10. Reward Integrity and Public Service

A successful state does not only punish wrongdoing.

It should also recognize integrity and outstanding public service.

Judges, civil servants, police officers, military personnel, public officials, elected representatives, teachers, doctors, and other public servants who demonstrate exceptional honesty, professionalism, and service to the people should receive recognition through transparent and merit-based systems.

Pakistan should create a culture in which honesty is respected, integrity is rewarded, and public service is honorable.

11. The Oversight Institution Must Also Be Accountable

We are not calling for the creation of another institution that becomes an unelected ruler of Pakistan.

We want a constitutional system of checks and balances.

Therefore, the proposed oversight institution itself must operate within clearly defined constitutional limits.

Its:

powers;
appointment process;
finances;
decision-making procedures;
conflict-of-interest rules; and
accountability mechanisms
must be transparent and subject to appropriate legal and constitutional review.

No institution should have unlimited power.

Our Vision for Pakistan

We want a Pakistan where:

The Constitution is supreme.

The law applies equally to everyone.

Accountability is impartial.

Justice is independent and transparent.

Public power is treated as a trust.

Corruption is investigated without political discrimination.

Honest public servants are respected and rewarded.

Citizens do not need political connections or personal recommendations to obtain justice.

We want a Pakistan where the poor can access justice, young people have opportunities, children receive quality education, patients can access proper healthcare, and hardworking citizens can live with dignity and security.

Our National Appeal

This petition is not against any individual or institution.

It is a call for a better system.

Political power, government office, wealth, influence, and authority do not last forever.

History repeatedly demonstrates that arrogance, abuse of power, injustice, and corruption ultimately weaken nations and institutions.

Pakistan does not need the rule of personalities.

Pakistan needs the rule of the Constitution, law, justice, integrity, transparency, and public welfare.

Our Final Demand

We call upon the Government of Pakistan, Parliament, and all relevant constitutional institutions to begin a serious national process of constitutional and institutional reform.

We demand the establishment of a strong, independent, non-political, transparent, and constitutionally accountable National Oversight and Accountability System that:

establishes effective checks and balances among state institutions;
strengthens constitutional supremacy;
promotes equal accountability under the law;
combats corruption and abuse of public authority;
protects fundamental rights;
strengthens transparency in public institutions;
protects the independence of the judiciary while ensuring lawful accountability;
provides appropriate oversight of law-enforcement and national-security institutions; and
advances Pakistan toward becoming a genuinely just, transparent, democratic, and welfare-oriented state.
🤝 Our Appeal to the People of Pakistan

If you believe that Pakistan should be a country where the Constitution is supreme, the law is equal for everyone, corruption is investigated without discrimination, honest public service is rewarded, and the public interest comes before personal or political interests, please sign this petition.

Share it with your family, friends, colleagues, and fellow Pakistanis.

Let us work together for a Pakistan where no individual is above the law, no institution is beyond constitutional accountability, and the people are treated as the true source and beneficiary of public authority.
