Требуем прекратить давление на пермский «Мемориал»

31 октября 2019 года сотрудники ФСБ, полиции, регионального Управления СК РФ и Центра по противодействию экстремизму МВД РФ по Пермскому краю провели обыски в офисе пермского правозащитного общества «Мемориал», а также в жилых помещениях его руководителя Роберта Латыпова. Обыски проводились в рамках уголовного дела о незаконной вырубке леса в урочище Галяшор Кудымкарского района Пермского края (в действительности речь идет о расчистке кладбища, на котором захоронены репрессированные спецпереселенцы - литовцы и поляки, высланные в Галяшор в 1945 году).

Ранее, 9 октября, Министерство природных ресурсов, лесного хозяйства и экологии Пермского края оштрафовало «Мемориал» за «незаконную вырубку» в Галяшоре на 200 тыс. рублей, Латыпова – как руководителя организации – на 50 тыс. рублей. Административные штрафы также были назначены некоторым литовским участникам экспедиции – их обвинили в «самовольном занятии лесных участков».

В августе 2019 года в Галяшоре работала международная волонтерская экспедиция «Мемориала», целью которой было облагораживание территории вокруг мемориального знака, возведенного в 1990-х годах в память о сосланных туда в 1940-50 гг. и похороненных на местном кладбище жителях Литвы и Польши, а также – сбор и исследование исторических данных. Участники экспедиции утверждают, что не занимались рубкой деревьев ни на кладбище, ни на территории поселка.

Незадолго до окончания экспедиции в лагерь нагрянули полицейские, которые, по сообщениям ее участников, до двух часов ночи расспрашивали их о ее деятельности на территории Кудымкарского района. Позже полиция возбудила административное дело – за «самовольный захват лесных участков» (ст. 7.9 КоАП РФ) и уголовное – в отношении местного жителя, у которого остановились литовские граждане, по статье 322.2 УК РФ «Фиктивная регистрация иностранного гражданина». 

У нас нет сомнений, что действия правоохранительных и других государственных органов являются попыткой оказать давление на пермский «Мемориал» с целью заставить организацию отказаться от деятельности по сохранению памяти о пострадавших и репрессированных в советское время. Преследование тех, кто восстанавливает память о спецпереселенцах – это новые репрессии против репрессированных. Особое раздражение местных властей, по-видимому, вызывает факт участия в экспедициях «Мемориала» родственников репрессированных, а также исследователей из Литвы, Польши и других зарубежных стран. 

Давление на «Мемориал» происходит на фоне продолжающегося общего наступления репрессивного аппарата на независимое гражданское общество в России. Некоммерческие организации объявляются «иностранными агентами», на них накладывают огромные штрафы и ликвидируют, а их руководителей и активистов нередко подвергают наказаниям по абсурдным обвинениям.

Самоотверженная деятельность немногих оставшихся в России свободных негосударственных организаций по увековечению памяти жертв советских репрессий не должна быть наказуема. Фактически они исполняют в этой области функцию самоустранившегося государства. Репрессивные инициативы региональных должностных лиц в отношении этих организаций идут вразрез с Концепцией государственной политики по увековечению памяти жертв политических репрессий, принятой Правительством РФ в 2015 году. Органы власти должны не противодействовать, а всячески способствовать такой деятельности.

Мы выражаем поддержку пермскому «Мемориалу», требуем от властей снять все надуманные обвинения и прекратить всяческое давление на одну из самых авторитетных правозащитных организаций России. Мы обращаемся к прокурору Пермского края, краевому Управлению Следственного комитета РФ, руководству региона с просьбой проверить основания и законность действий государственных органов в отношении «Мемориала».

Заявление открыто для подписи всем, кому небезразлична судьба гражданского общества в Пермском крае и России. Его уже подписали ряд ученых, журналистов и общественных деятелей.

Stop the persecution of Perm Memorial

On 31 October 2019, officials from the local agency of the Russian Federal Security Service (FSB), the Centre for Combatting Extremism and police carried out searches in the Perm office of the human rights organisation Memorial and the home of its head, Robert Latypov. The officials based their searches on the criminal proceedings against Memorial illegal deforestation in the village Galyashor in the Kudymkarsky district of Perm Krai (what really happened was a clean-up of a cemetery where the special settlers of the Stalin-era -Lithuanians and Poles that were expelled and forced to resettle in Galyashor in 1945 are buried).

Earlier, on 9 October, the Ministry of Natural Resources, Forestry and Ecology of Perm Krai fined Memorial a total of 200 000 rubles (about 2840 euors) for alleged “illegal forestation” in Galyashor. Ropert Latypov, the head of the organisation, was fined 50 000 rubles (about 710 euros). Administrative fees were also imposed on all five Lithuanian participants of the expedition – they were accused of “unauthorised occupation of forest land”.

In August 2019, an international volunteer expedition of Memorial worked in Galyashor to clear and improve the area around a memorial sign, which was erected in 2016 in memory of the residents of Lithuania and Poland who were deported to Galyashor between 1940 and 1950 and buried in the local cemetery. Another aim of the expedition was to collect and study historical data. The expedition participants assert that they have not been engaged in the tree felling neither in the cemetery, nor in the former village territory.

Shortly before the expedition ended, police officers broke into the camp, and, according to the participants, questioned them until 2:00 in the morning about their activities on the territories of the Kudymkarsky district. Afterwards, the police opened an administrative case for “unauthorised occupation of forest land” (art. 7.9 of the Code of Administrative Offences), as well as a criminal case against a local citizen, with whom the Lithuanian citizens had been staying, on art. 322.2 of the Criminal Code of the Russian Federation on “Fictive Registration of a Foreign Citizen”.

We have no doubt that the actions by law enforcement agencies and public authorities are an attempt to put pressure on Perm Memorial in order to force the organisation to give up their work on remembrance of victims of Soviet repression. A persecution of those who are restoring the memory of forced settlers is in fact a new wave of repressions against the repressed. Local state officials seem to be particularly irritated by the fact that relatives of the victims as well as volunteers from Lithuania, Poland and other countries took part in the expedition. 

The pressure on Memorial is taking place against the background of ongoing general repressive measures on the independent civil society in Russia. Non-profit organisations are declared “foreign agents”, they are subject to heavy fines and liquidation, and their leaders and activists are frequently penalised on fabricated charges.

The dedicated work of the few remaining free nongovernmental organisations devoted to the memorialisation of victims of Soviet repression in Russia should not be punished because such organisations are in fact performing the function of the state in an area where it has pulled away from its responsibility. The repressive measures by regional officials against these organisations run counter to the government’s framework policy on the memorialisation of victims of political repression, which was adapted by the government of the Russian Federation in 2015. The authorities should not be counteracting such activity, but rather do everything in their power to promote it.

We express our support for Perm Memorial and demand the government to drop all false charges and stop all kinds of pressure on one of the most respected historical and educational as well as human rights organisations in Russia. We call on the prosecutor of Perm Krai, the regional department of the Investigative Committee and the leadership of the region to review the grounds and legality of the public authorities’ actions against Memorial.

This petition is open for signature to everyone, who cares about the destiny of civil society in Perm Krai and in Russia. Many academics, journalists and public figures have already signed.
