Shouldnt every violation and violator should be treated equally under the law

You would have recently read Sabrang Communications and Publishing Private Ltd. and Teesta Setalvad and Javed Anand who are its directors were charge sheeted used under FCRA 1976 (and IPC) in CBI's complaint filed recently (see link). So violation of the law as it existed then is the law under which they will be prosecuted. The case was referred to CBI by the Home Ministry. But when it comes to political parties, how did the Home Ministery forget ( despite a Delhi High Court ruling pointing out) that both BJP / INC – registered under Representation of People's Act - violated the same FCRA 1976 as it stood then. This matter was not referred to CBI or any punitive action permitted under law taken. Why Home Ministry chose not to take legal notice? The political parties too unauthorisedly took foreign contribution – when clearly not entitled to do so. To suit its political masters did the Ministry look away when the law itself was sought to be changed? The changes were to the FCRA 2010 law – not the 1976 law which was violated... We need transparent compliance with laws that govern political parties. We need to demand transparency in political funding Hence this petition is timely and relevant
