Dear Supporters,

In 2022, I filed two Freedom of Information Act requests with the US Food and Drug Administration, requesting documents showing how the FDA justifies their decision not to comply with 21 U.S.C. 360ii to establish and maintain a liaison with NHTSA to test, evaluate, and set performance standards for LED products, including LED headlights.  The FDA failed to provide the requested documents.  On January 21, 2025, I filed a FOIA lawsuit against the FDA.

These records will establish for the court whether or not the FDA has engaged in reasoned decision making when deciding not to collaborate with NHTSA to test and evaluate LED headlights. (Hint: The FDA has acted dishonestly and in bad faith and these records or the absence of these records will prove this).  The first hearing is scheduled for June, 2025.
