
In a desperate attempt to continue concealing their negligence and criminality, Police Scotland have accused the witnesses who confirmed they made 2 calls to the Police the evening before Barry was murdered, to report Smullen violently attacking a young boy at a play park, of lying.
Fortunately there is evidence of the calls and what was said but what if there wasn’t?
The witnesses were visited by Police Scotland a few days after Barry was murdered and a statement was obtained. They had calked Police Scotland to report the assault as it was happening and watched as a Police vehicle attended and apprehended the victim of the assault, driving away leaving Smullen standing in plain view. They immediately called Police Scotland again to advise they had apprehended the victim of the assault and had to return for Smullen, but they did not come back for him. Smullen was still behaving violently, punching the air with a metal chain or knuckle duster wrapped around his fist.
Police Scotland claim the first call they received reported a disturbance and the second call reported the males involved in that disturbance were back in the street. This is false because we have evidence of the calls. This incident was vital evidence as confirmed Smullen was already on an angry spree of violence before he murdered Barry. This incident would also have helped to corroborate the second violent attack reported to Police Scotland before Smullen murdered Barry, as the description of his behaviour at both incidents by different witnesses was almost identical. When a statement was obtained from the witnesses days later this assault was confirmed and corroborated but it was hidden by Police Scotland. These witnesses asked the officers who attended to obtain a statement why they had not returned to apprehend Smullen after their second call and they were told that a Police vehicle had driven into the street a while later but there was no sign of Smullen - this was a lie.
After the trial we asked the detectives involved in the investigations why this incident had not been detailed in the case against Smullen and they said that the assault was not corroborated and that Smullen was seen on CCTV in another area at the time - this was a lie. The assault was confirmed and the statement of these witnesses was unarguable.
The attempt by Police Scotland to allege these witnesses have contacted us with false information as some sort of twisted act, to subject us to considerable trauma, lying about the calls they made is beyond comprehension. It is intimidation in an attempt to continue concealing negligence and criminality and these officers should be in prison. At times we were also subjected to intimidation by the officers involved, angry that we were questioning information that just wasn’t right - all of our concerns were confirmed as time went on.
How can the public have any trust in a corrupt Police Force and what a slap in the face to the thousands of Police Officers out there working day and night with integrity, and at risk to help people and keep them safe.
There is no question that the efforts of Police Scotland to conceal this incident is linked to them falsely stating to the Crown in writing at least 3 times that Barry had been found naked wearing only boxer shorts when it was never true. They also told us the same, and despite continually questioning this unable to belief Barry undressed in the property where he was murdered, Police Scotland only admitted to sending false evidence to the Crown after the trial. How many times have these officers provided false evidence in serious cases, it’s scandalous. PIRC instructed Pplice Scotland to write to us within 3 months confirming the individual and organisational learning identified after sending false evidence to COPFS but 6 months on we are still waiting - is that because it’s normal for this to happen?
A few weeks before Smullen murdered Barry he failed to comply with the conditions of his bail and curfew and the officers involved just let him off, how many times has this happened and why? If they had apprehended him to appear in front of a Sheriff for breaching 3 bail orders and a curfew, he would most certainly have been remanded in prison and Barry would still be here.
Smullen’s mother, his younger brother and friend went to the property where Barry was lying bleeding to death to make efforts to conceal Smullen’s involvement, they took photos of him bleeding out unable to get away and Barry is heard screaming out repeatedly in the background of the call recording played in court. That’s the last time we heard Barry’s voice, screaming out ‘NO’ repeatedly, surrounded by 3 monsterous faces of evil. We are certain the second post mortem will confirm what they did to Barry, it has already been confirmed he was dragged onto the mattress where he was found.
It’s taken a long time, through a lot of trauma but the SPSO have upheld all of our complaints, the Scottish Fatalities Investigation Unit have confirmed they are now investigating, as have the Criminal Allegations Against the Police Division of COPFS, so we feel confident that time is running out for these corrupt officers of Police Scotland who have continued to lie, despite repeated opportunities to admit their negligence and apologise.
We would really appreciate information from anyone who witnessed any incident involving Robbie Smullen in the weeks leading up to Barry’s murder, or involving his mother (who was criminally convicted for perverting the course of justice) or his younger brother who was with his mother in the property as Barry was dying. Even if you already provided information to the Police, any information would be helpful and would not be shared with our solicitors without your permission.
Smullen was a known violent coward who would not have confronted anyone without a weapon in his hand, he should not have been out among the public, left at large on a spree of violence to murder our child. Until these officers are dealt with and until the other individuals involved are brought to Justice, this will happen to someone else.
