First thank you for all your support! It is one year since the proposed development sign went up at Waverly Woods.

Here is an update about the Ontario Municipal Board appeal for Waverly Woods. There will be a Prehearing Conference on November 28th at 10 at Fort Erie Town Council chambers. This is a public meeting, so anyone can attend. The purpose of this event is to establish the issues and list the experts. Another important part of this event will be the identification of parties, witnesses and participants.

 Party

A party is anyone who wants to participate at the hearing in an official capacity. They would need to attend on November 28th to make a request for this status and they may have to provide reasons why they should be granted party status over participant status. To do this they will need to have a general idea of what they will be presenting and/or submitting at the eventual hearing- what your issues are, how many witnesses you will be calling etc. A party has to be someone who participated previously at a public meeting or with a written submission on the Waverly Woods (Harbourtown) development.

 Witnesses

Witnesses are experts such as planners or engineers. They can also be non-experts such as neighbours. Witnesses may be cross examined by other parties.

 Participant

A participant is someone who wants to make a statement to the Tribunal about the appeal. A participant is granted that status by the Member at the prehearing. During their submission they can touch upon several topics or issues that support their argument. 

In both cases witnesses or participants are not limited to someone who has previously participated. 

If you know of any experts, we would be delighted to meet with them formally or informally. Categories may include lawyers, planners, hydrologists, biologists, historians, cultural heritage, etc.
