Hello Fellow Residents, Ratepayers and Community members
On Wednesday the 14th August 2024 I attended the Judgment Hearing at the Land and Environment Court in the city.
It turned out that I was the only person there along with two junior legal representatives to hear the Judgment in relation to the Subpoena lodged by Liverpool Council.
In a nutshell as I understand it - A verdict was handed down regarding the Subpoena lodged by LCC which was deemed to be a bit of a fishing expedition against Mr Whitworth from OLG so it was disallowed.
That's a small win for the Minister for Local Government.
WHERE TO FROM HERE?
There is a directions hearing set down for Friday the 23rd August 2024 in front of Judge N Pain.
That will then lead to a Final Hearing Date to be set down.
AND it's getting more painful for the ratepayers of Liverpool everytime there is a Court Hearing. The SMH reported on the 14th August that ........
"After three days in court, a directions hearing is scheduled for August 23. A confidential report about the hearings stated council had already incurred $300,000 in legal fees, double the amount estimated before the matter commenced.
“The risk [of the ongoing legal matter] is deemed to be high with potential financial and reputational impacts,” the report stated."
AND THAT IS JUST THE START
Therefore the Council Elections will go ahead unless the final hearing is held and determined before the 14th September, which is doubtful the way things are going and then if the Government is successful it might be that the newly elected council goes into Administration.
Which is very disappointing as it means that the new council gets smeared with going into Administration for the behavior and actions of the current Council.

Here is a part of of the rambling rant
"They ( the OLG) argued they are relying on angry letters from Nathan Hagarty, Charishma Kaliyanda, the Unions, and Peter Harle. Add Peter Ristevski and Michael Andjelkovic and you have the group of people who are obsessed with destroying the progress in Liverpool and are prepared to tear up MILLIONS of dollars of precious ratepayer money on cancelling the election and holding a public inquiry.
These are the people who want my team and I sacked and they don’t want to fight fairly at an election. They are like the bad guys in Karate Kid, they punch below the belt or break an opponents leg because they are scared to fight them fairly and squarely."
Now I personally disagree with these allegations and will refute them but NOT in this post.
