McKinnon’s statements pertaining to Vance On three separate occasions McKinnon has tried to clear my husbands name. First with the letter, second at her sentencing, and then in a letter she wrote in support of his commutation. Below are some of her comments from each one. THE LETTER I am writing this letter in an effort to provide information I believe pertinent to an on-going investigation by the FBI relating to Douglas William Vance (Vance). It is my understanding that the FBI has questions relating to several instances where I have first-hand knowledge of many of the facts. The bad part is that Vance made it easy and didn't have a clue. He had given me his email password early on and never changed it. I sent him the emails and then opened them on his end to make it appear he had already read them. Until I told Vance about the bogus sales and "blackmail", he had no knowledge of what they had told me to do and had no involvement in it whatsoever. I know what I did was unforgiveable but all I can say is I am terribly sorry. I was in a horrible situation and still am but I truly didn't see any other way out at that time. I do now. This letter is my first step in trying to do so. SENTENCING I wrote a letter (Vance exhibit 1) detailing my role and what happened in this case. I gave that letter to Mr. Vance in November of 2018. I told him it was okay to give the letter to his attorney. And to my knowledge, he did so at that time. Mr. Vance mentioned this letter in his interview with the FBI agent in December of 2018. That interview was recorded, and you clearly hear Vance and the agent discuss my letter. See government exhibit number 401. Vance advised him that the letter was in his attorney's possession. Vance did not give the letter to him at that time because I asked him to wait until I could afford to hire an attorney. I was unable to pay for an attorney but was finally appointed one when I was indicted. At that time, I told Mr. Vance it was okay to give the letter to the FBI. The agents mishandling of this key piece of evidence gives the appearance of, at the very least, a rushed investigation and an investigation that was conducted without regard for detail. When you couple this "lost" piece of evidence with the obviously inaccurate and faulty data that the Agent used in preparing the government's financial spreadsheet, I believe you can understand why Vance and I have absolutely NO agreement with the Government's determination of the loss amount. COMMUTATION Please allow this letter to serve as confirmation that I wrote the letter referenced in the December 19, 2018 recorded FBI interview with Doug Vance and FBI Special Agent. (Please see attached letter. Govt Exhibit #401 is also an audio recording of that interview.) Contrary to the Prosecutor's creative assertions this letter was not self-serving hearsay to create a defense for myself. On the contrary, I admitted what happened, what I did and unnecessarily incriminated myself because the FBI's investigation was focused on Vance only, not me. This letter totally exonnerated Vance, NOT ME, so the assertion that I created this as my defense 2 YEARS BEFORE I was even a target is ludicrous and flies in the face of facts and common sense. When I gave the letter to Vance, I told him he could give it to his attorney but requested that he not give it to the FBI until I could retain an attorney. I never had the funds to hire an attorney so | was ultimately appointed one after my indictment on June 18, 2020. Vance honored my request. Complete documents available upon request. Letter and sentencing statements are part of the trial record.
