In an article in the Law Society of Scotland Magazine, a US attorney warns that Scottish salmon farms must stop shooting seals and using Acoustic Deterrent Devices (which disturb and can cause hearing damage to porpoise, dolphins and whales) within 18 months, or find the USA export market closed to them.
Killing seals and harming cetaceans violates the US Marine Mammal Protection Act. Scotland must upgrade legislation and enforcement of marine mammal protection comparable to US standards by March 2021 or face a US export ban.
But with little time to address the issue, civil servants at Marine Scotland continue to avoid enforcing the law protecting porpoises, whales and dolphins from disturbance and injury by ADDs and continue to allow the shooting of seals.
If farms fitted double nets or closed containment they would not kill seals or harm cetaceans.
