What good is WI Act 88, if there appears to be no enforcement or oversight?


I recently made an inquiry as to how background checks are performed within the Department of Public Instruction in the State of Wisconsin, and the resulting conclusions are mind baffling...
From the legislative end, it would appear that the state does take student safety to be a serious concern as it implemented Act 88 roughly ten years ago.
It would seem that school districts were Led to believe that registered Sex offenders that violated act eighty eight would be charged for Not notifying school districts of their presence on school grounds....
For years school districts have thought that they were safe from registered sex offenders on school grounds. For some reason many school administrators thought that the background checking system/software would indicate "a hit" on anyone that was a registered sex offender.
I don't know who or what is responsible for giving school districts such a false. Sense? Of security but it's gone on for years without question. In reality, "Raptor" Does not really identify all registered sex offeders. While it will identify many registered sex offenders, it does not identify those sex offenders that have almost always been protected by some sort of shield of invisibility.
While Wisconsin's Act 88 suggests that it applies to adjudicated juvenile offenders, Raptor seems to be unable to detect any registered sex offenders that are characterized as adjudicated it juvenile delinquents.
What does that mean in simple terms? It means that 1st and 2nd degree sexual assault offenders that committed their crime prior to their 14th birthdand are out in today's public maybe in their. Teens, twenties, thirties, forties's, etc. are living among us and we have absolutely no insight as to their presence.
School districts were misled to. Believe that raptor would identify all registered sex offenders, but somehow it doesn't identify the key population that may be considered most dangerous to our youth. Why would I suggest that the popution is so dangerous? It's because since such offenders committed the crimes they were charged with prior to their 14th birthday, their target audience is most likely young children. And despite laws that have been created to prevent their presence on school grounds, there is no checks or balances system ensuring that registered sex offenders that had been charged as a judicated delinquents are reporting their presence to school districts, nor is there any checking or oversight to identify if such offenders Try to get away with their presence on schoolgrounds... As the background checking software that the school districts use will not create "a hit" on such registered sex offenders.
In essence it all comes down to an honor system, That somehow relies on self reporting by by registered sex offenders that were adjudicated delinquents despite their proven history of disregard for laws and regulations for their crimes against humanity.
For those of you that read about my daughter's incident that I referenced in my petition, I am sad to report a very disturbing update...
My daughter's offender was charged with another sex related crime roughly one year ago... While the second victim to report his actions to law enforcement, Her physical appearance and certain characteristics that sbe incaptulated we're very similar to keep traits and characteristics of my daughter. While I do not know all of the details of the second encounter, But would imagine that a dangerous weapon may not have been used in the attack, the victim was targeted while she was unconscious.
Although the offender was charged with the crime well over a year ago he will not become part of the public sexual offender registry until he is officially convicted.
Additionally my daughter ran into her offender's presence at a facility that conducts background checks on its members, in an effort to ensure the safety of its members...
School districts and other organizations that provides services to young children and believe that they are running thorough background checks have been misled to believing that the background checks that they were running were completely thorough.
When I brought the fact that my daughter's sex offender did not seem to generate a hit using a school district's background checking system, both school administrand respective school board members were taken aback that such a critical loophole continues to exist.
Well I do not have the exact number of years. The school district has an on site school resource officer that failed to make the district aware that they're background checking software may not actually identify all registered sex offenders, and that it was indeed flawed.
While people may like the idea of living in a world in which they feel secure, the truth is they have been misled and really have a false sense of security.
I don't know if anyone was ever identified as having to enforce or ensure oversight of Act 88, but it's obvious that it's not working as intended.
In fact the very address that my daughter's registered sex offender reports himself to live at is directly adjacent to the school grounds of an elementary school for gifted children... Although kids have been taught about good touch and bad touch since day care for the last 20 years? What are the chances that a very young student would report such behavior even if such a student is labeled as being gifted? Especially Since the school is located in an area of a city that prohibits sex offenders from residing within city limits.
But yet once again it appears that registered sex offenders that were adjudicated as juveniles have some sort of invisibility shield even from city law enforcement. I don't know if city law enforcement uses the raptor system as well, but one would think they should easily have the ability to access the complete sexual offender registry, and enforce it, but that isn't happening....
Not only does automation of finding a hit on registered sex offenders that were adjudicated as juveniles fail to exist, City law enforcement claims that they are unable to act even when informed of the presence of such registered sex offenders that are grossly in violation of several different laws.
Where imare the checks/balances and oversight? Who is letting the ball drop? Is the fact that it's being dropped created by design? Why have law enforcement officers not addressed? The matter that there is a huge population out there that is being missed by background checking software? Why are they not pointing out to their superiors that there is a breach in their system that it is not working? She's at agree should the degree or level that's society expects?
Why has the public been misled to have this full sense of security? If society is going to have a sex offender registry in the Public believes that they have access to it, Why not Provide the public access To the complete registry? Why does a private registry, and the existence of a private, private registry continue to remain?
I tried to be proactive; I tried to prevent my daughter's offender from claiming another victim; but my pleas fell on deaf ears.
How many more victims will there be before anything is done? Why not make the sex offender registry all inclusive, at least of all first and second degree registered sex offenders? What is the point of creating legislation if no one seems willing to ensure that such laws are followed and enforced?
While something should have been done long ago, there is nothing anyone can do to change the past. However, we do hold the power to act in the present and effect. Our lives today as well as the lives of future generations.
