Dear Kirklees Council Petition Committee.

I really am not happy with the council currently.

The main Website form is always giving an error when I submit a petition from the Desktop computer so I have to do it on the mobile phone browser.

Also you don’t seem to reply. Just ignore submission’s & correspondence now.

I have submitted to request to you.

And another thing is the Cllr Bernard McGuin Petition that its been reported in the newspapers the council “Will not be hearing it” because they already made a decision on the matter.

With Planning Applications & Decisions a planning Application is its own proceedings. With its own Meeting/s & time allotments.

Its true there is a window (limited) during those proceedings & decisions for petitions to be allowed to be submitted & heard briefly as evidence, in proceedings that are for a planning application.

But a Petition itself is its own case for something & its own set of proceedings in pursuit of (full council) on a matter & also there may exist other petitions that must by law be included & combined on the same subject or where connected & they will have their own matters as well, that are nothing to do with a Planning application.

You cannot therefore claim that a matter has “already been decided” in proceedings for someone else’s planning proceedings when there is a LIMITED time slot to be (allowed) to hear petition evidence. When there may be other petitions not yet combined & that include issues & matters that are beyond the scope of a planning proceedings but relevant to the petition & sites & also the other open petitions.

A petition IS its Own pursuit of Proceedings & Can in Fact trigger a local referendum or even be directed to central government. A planning application for a development cannot be proceedings about the future, conservation, or other matters of a petition that is about the site generally & other matters such as Heritage.

I Strongly believe that The Council is Wrong about claiming Cllr Bernard McGuin’s petition & the others about castle hill cannot have their own proceedings & decision. The right to petition is a Right to brig a case. Its own Case & proceedings.

It is not Proceedings for another party’s Planning Application. Its only that evidence from a petition can be heard in those meetings.  (The needs of other cases) Just like in law you might have a seperate Civil & Criminal case but the evidence presented might be needed to be used in one case. & can be used. But it is not the other proceedings.
