Whew! It’s been a while! Lots of updates that we’ve needed to hold off on to share but now is the time!
Our TORT claim officially turned into a Federal TORT lawsuit several months ago. We are in the initial stages of filing. So far the government has filed a request for dismissal, we subsequently amended our complaint and their dismissal was found moot. We are in the waiting stages to see what happens next. The deadline for the defense is today. We will see what happens.
in the meantime Jolly has been receiving healthcare in the community through VA community care. There have been no issues with his care or referrals up until a few weeks ago. Suddenly in the midst of the lawsuit and ironically the same day the government filed the motion to dismiss suddenly he no longer exists in community care.
As of today Jolly is 3 days out of his medication. The second time the Salem VA medical center has directly intervened to disrupt his mental health care.
Last night at close of business he received an email from the VA telling him the only option was to come back to the Salem VA for care and they included an extension for him to call.
I spent the early morning attempting to call the extension only to find out that the number they gave has been dead for over three years and this is well known to the Salem VA.
After being pushed around to multiple extensions with no help and with my patience running incredibly low I decided to reach back out to our congressional office to update them on what is happening.
As of now Jolly is effectively without care and without his medication yet again at the hands of the Salem VA medical center.
