Brianna cannot fight for Journi in Texas. The Supreme Court of Texas has denied her that right and so has the second court of appeals in Texas. Both courts ruled with the family court in Tarrant county. (360th district court)
By law, Brianna is prohibited from regaining custody of Journi. It’s indefinite as the post stated weeks earlier.
However, family that has standing legally can petition to adopt Journi or begin visitation. This petition has to be in the same court that terminated Brianna’s parental rights with the same judge. This petition can be denied by the same judge if she believes it’s not in the best interest of Journi, the foster family can challenge our petition as well since they have had custody of Journi.
Best interest is the only factor here. Fighting for Journi isn’t about what we want any longer it’s about What is in the best interest of Journi by the Foster care definition.
The agency that Journi is under is foster care and a particular foster adopt agency. You will need to contact her attorney ad-listen for that Information. As family we cannot go through the foster adoption agency because the court has not recognized us as a party to the case. Once we are recognized as the party to the case then we can access free services within foster adopt to send letters, birthday gifts, pictures and even visit with Journi at the very least.
Placement will be the biggest hurdle because of what we already stated.
Brianna isn’t able to legally gain custody ever.
As unfortunate as it is- this fight doesn’t include Journi going home with Brianna.
Family would like the chance and we will do what we can to have that chance for Journi.
