Ontario Superior Court Denies City of Kingston Decampment Injunction

Since yesterday we have yet another court precedent to work with pertaining to park decampment amid lack of shelter space.

This time the decision comes from the Ontario Superior Court. Since the argument revolves around the Charter, as usual, the precedent can be expected to hold in other provinces as well.

In his decision, Justice Ian Carter reasserted the unhoused's right to sheltering in municipal parks if there isn't an alternative such as shelter beds. The judgement borrows from the Waterloo case, although Carter declines to endorse it to the fullest extent, instead granting an exception only for temporary overnight shelter.
