🚨 URGENT UPDATE: DMANTE ANDERSON'S CASE
WHAT HAPPENED
On August 12, 2026, Judge Brian E. Lake GRANTED Dmante Dontrell Anderson a Motion for New Trial in DeKalb County Superior Court.
BUT Judge Lake gave the State 90 days to prepare for retrial.
The problem? The Double Jeopardy Clause has been brutally violated. The State cannot constitutionally try him a third time.
THE DOUBLE JEOPARDY VIOLATION
On February 9, 2022, ADA Joanna Helsby:
· Told witness Melissa Jordan to call Dmante "a menace to society" despite a direct Court order not to
· The Judge found Jordan did it "on purpose"
· Helsby lied to the Court, saying she didn't solicit it
· Then Helsby violated another Court order and tried to introduce inadmissible double hearsay
· The Judge declared a mistrial due to intentional prosecutorial misconduct
Under Oregon v. Kennedy, when the State intentionally provokes a mistrial, retrial is BARRED by the Double Jeopardy Clause.
The State already had two trials. A third is unconstitutional.
Dmante is now fighting to stop the third trial before it happens.
THE BOTTOM LINE
Dmante Dontrell Anderson is an innocent man who has already been tried twice. The State intentionally caused the first mistrial. The Constitution says he cannot be tried again.
Judge Lake granted a new trial but ignored the double jeopardy violation. This is wrong. This must be stopped.
