Mr. Johnson’s pending motion has been reset for conference in January by the US Supreme Court. We are hopeful that SCOTUS will grant Johnson clemency based on the claim that the seizures he endures due to a brain tumor will cause cruel and unusual punishment during the lethal injection process. Ernest Johnson should not be eligible for execution in the first place. The claims denying him relief under Atkins are based on stereotypes about people with ID/D. He deserves to have his ID/D claim heard before a panel of experts and litigated to the full extent of the law.  We are grateful that we have another month to gather signatures and build support for #ErnestJohnson.
