Hello,

This is my contribution to Citizen's Discussion at Tuesday's City Council meeting:

Good morning,

The city admitted to me in 2018 that Rocky Mountain Field Institute had been doing $40,000 a year in work on the section of the Barr Trail that the city acquired from the Cog Railway in the land swap with the Broadmoor Hotel every year since 2013.

City Officials today do not feel that they have an obligation to tell the public of this fact?

Each Citizen has a right to decide for themselves whether this justifies a lawsuit.

The city is  deciding for them.

I claim that the appraisal that the Broadmoor submitted for this land is invalid.

No Citizen has a right to legal recourse in order to let a judge decide?

A Citizen asked about the cost of the needed repairs on that land over and over and over during the public comment process, the city refused to answer.
I find it hard to believe that Karen Palus did not know about the work at that time.

She gave a presentation at every public meeting.

Surely RMFI informed the managers of the Manitou Incline every time they were going to have workers on that section of the trail every year.

They would be required to do so.

Our Parks Director did research and gave presentations on the merits of the land swap, it is next to impossible to believe that she did not know about the work.

Even if she did not have prior knowledge of the annual work being done she had to learn of it after hearing me ask.

I spoke at public meetings and sent emails during the public comment process detailing visible need for repairs on that trail.

Why did the city refuse to provide the information that I requested during the public comment process?

“A Citizen is asking for the cost of the repairs, we will get a professional estimate and present it to the public”.
Why is the city refusing to provide that information to me or to the public ten years later?

We forbid any Citizen to know of our mistake or the fact that the land in question still needs $??,???,???.??$ in repairs today.

We do not allow any Citizen to take legal recourse against our land swap.

I challenge City Officials to rise above the mistakes of the past and resolve this matter now.
