A person commits **federal cyberstalking** if they:
With intent to kill, injure, harass, intimidate, or place under surveillance another person, they use:
- The internet
- Email
- Social media
- Any “interactive computer service” or electronic communication (basically anything online)
- Mail or other interstate commerce tools
…to engage in a **course of conduct** (two or more acts) that either:
**(A)** Places the victim in reasonable fear of death or serious bodily injury (to themselves, family, spouse/intimate partner, or even pets/service animals), **OR**
**(B)** Causes, attempts to cause, or would reasonably be expected to cause **substantial emotional distress** to the victim.
Key points
- It doesn’t require physical following or showing up in person (that’s the travel part in subsection 1).
- Purely online behavior qualifies under subsection (2).
- “Substantial emotional distress” is the big one for most cyberstalking cases — repeated harassment, doxxing, death threats, pile-ons, etc.
- Intent matters — prosecutors have to show the person meant to harass or intimidate.
Penalties
- Base penalty**: Up to **5 years** in federal prison + fines up to $250,000.
- If serious bodily injury** occurs: Up to **10 years**.
- If permanent disfigurement or life-threatening injury**: Up to **20 years**.
- If death results: Life in prison.

Sustained online attacks that destroy someone’s marriage, career, finances, and mental health — especially when they’re coordinated and relentless — can absolutely meet the “substantial emotional distress” standard. The law was updated (especially in 2006 and 2013) specifically to cover cyberstalking because people realized the internet made traditional stalking laws outdated.
