Unconstitutional application of Megan's Law
The Issue
Clay Levar Evans was accused of a crime of endangering the morals of a minor in 2001.He was convicted in 2002..The resultant disciplinary action was unconstitutional according to the concept of Cruel and Unusual Punishment When considering all of the circumstances surrounding this particular case, there is a need to review the effect of the application of Megan's Law. and the unfair application of the same. There have been several cases similar to this one where Megan's Law was overturned due to the unfairness of it's application. In light of these circumstances, the application of this law should be re-considered, due to the affect it has on Mr. Evans ability to pursue another constitutional right. That right being the pursuit of enjoyment of Life, Liberty, and the Pursuit of Happiness. We request a review of this decision on the basis of it's unconstitutionality.
