Why my book, Holiday in Hell, by Trisha Smith is a call to amend a Canadian Criminal Code 6(2)?

 

My book, Holiday in Hell, published by Asteroid Publishing Inc. is a true^tragedy legal^drama, and relentless suspense chronicling years of my life from blind naivety to harsh reality: a brutal assault in 1999 on vacation in Cuba cannot be charged in my country Canada, or in Cuba!

Cuba makes a declaration right after the grave assault crime (a penalty of 14 years imprisonment minimal in my country Canada) however an ensuing legal clash occurs: upon the return to Canada, while I'm half unconscious because of the assault, which occurred just hours ago, the Canadian police refuse to arrest the Canadian at Pearson Airport! But why, please read on...

CITY-TV news broadcasts the despicable assault, which happened while I was asleep, and brands my case as ‘a legal complicate case’ - the media knew that was the only way to label my case, since in The Canadian Criminal Code 6(2) it states: 'A CANADIAN CANNOT CHARGE ANOTHER CANADIAN OF A CRIME COMMITTED AGAINST THEM, ABROAD!

In a matter of months, my legal advocacy becomes subject of 14 articles in Toronto Star, Globe and Mail, and Toronto Sun, while I am still trying to get justice - I'm calling each day and begging for protection from Justices of Peace, only to be responded with the same statement, ‘there’s no law to charge a crime that occurs abroad, even by another Canadian!’

Finally, I got a hold of a Justice of Peace who looks over the assailant’s records, finding the perpetrator is on a parole violation for another same violent assault!  This discovery involves the local police, the External Affairs and a full investigation leads my case into the Supreme Court of Canada, but still no law to protect me!

Newspapers and media coverage outrage Canadians, in a response to initiate a Canada-wide petition aiming to amend the Canadian Criminal Code 6(2) before the House of Commons, then CITY-TV broadcasts the event. However, then Justice Minister, Anne McClellan disappoints me and fails the 3,500 petitioners! In a true sense, the hard-hitting legal aftermath becomes the real crime!

My case is dragged through many riveting court dramas and become precedent-setting in the Supreme Court of Canada. The precedence is 'only' a new law enabling to charge repeating perpetrators, however the Canadian Criminal Code 6(2) still stands same: A Canadian cannot charge a crime committed against them by another Canadian, abroad! The CCC6(2) law has not be amended since my petition, 11 years ago! The precedent-setting did further credit the legislature of a law against child trafficking, abroad, since many of this kind of crime are repeated offenders on probation. However, the crime itself, the assault , which would have been a minimal 14 years of imprisonment in Canada, that crime committed against me in Cuba, while I was asleep, has not been ever charged, vindicated by a law, since there's no law in Canada to charge another Canadian of a crime committed against them, abroad! So where do I go to obtain protection, where do I get vindication of this grave crime against me, where in a world can I obtain compensation and resolution?

My legal case is a violation of my human rights in the international Human Rights Court. This is why my book, Holiday in Hell is a wake-up call to Canadians, conveying to set the wheels in motion to amend the Canadian Criminal Code 6(2) providing a jurisdictional law for the Canadian Justice System to grant Canadian citizens a jurisdictional protection that extends beyond “diplomats, victims of aircraft hijacking, hostage taking, protection of nuclear materials, torture, war crimes, piracy” to the entire Canadian population!                                                                                                                     www.holidayinhell.ca​
