The Issue

Shell Beach Condominium association (SBCA) is trying to extend a chain link fence beyond the high tide water line, thus encroaching on Public Beach. It serves no purpose except to add blight to the beauty of Long Island Sound & environs. They have not obtained the required permits from the Town of East Haven or Connecticut DEEP/ OSLIP.

As well, the SBCA ignored two Cease & Desist orders by OSLIP. They have also swept away the High Tide Debris Line (HTDL) with the knowledge that CT DEEP/ OSLIP enforcement offiicial is scheduled to judge whether the new fence is at or above the HTDL.

Your signatures will emphasize to the above parties that the SBCA needs to be held to honoring the rules and regulations that apply to all, and obtain the required permits.

This petition addresses our concern over various compliance issues regarding the Shell Beach Condominium Fence at the juncture of Old Town Highway and Morgan Ave.  In short, the issues address fence height, permitted proximity of structures on private property to the public road and safety site line issues around the fence & bushes. The attached letter & sitemap have been sent to the Town of East Haven on May 24, 2012 and May 30, 2012 and have yet to be addressed.

Separately, The Office of Long Island Sound Programs (OLISP) is addressing the requirement that the fence be built above the High Tide Water line.  In the state of CT, beachfront below the high tide line is Public Beach. They are now involved because the Shell Beach Condominium Board Assoc. did not request the permit required to build any structure on coastal water lands; and as well, the SBCB person spearheading the fence construction, Bill De Mayo, and his board ignored two Cease & Desist orders made by Kevin Zawoy, CT DEEP Office of Long Island Sound Programs Enforcement Officer, when they were installing the fence.
