SB115 fundamentally violates and takes away a woman's right to sole parentage. Current California law, established by statutory law (Fam. Code sec. 7611(d), 7613(b), 7630(b)) and strengthened by 26 years of case law, protects women who choose to conceive via a sperm donor the right to bear and raise their children as single mothers, without interference from the sperm donor himself. This law was carefully crafted to 1) protect a woman’s choice to conceive via sperm donation, without legal, emotional or other interference in the parenting of her child, and 2) to protect sperm donors from being sued for child support or other parenting obligations.
