Apologize For Using Slavery as Legal Precedent for Arizona Immigration Laws
The Issue
This petition demands that Supreme Court Justice Antonin Scalia issue an immediate apology to all African American descendants of slaves, for using as legal precedent, those laws which were the foundation for legalized slavery in our Southern United States. Justice Antonin Scalia's dissent over striking down most of Arizona's SB 1070 was a dangerous denial of our Constitutions 14th Amendment. In arguing for broader states rights (with respect to immigration), he went on what can only be described as an extremely disrespectful, politically driven racist tirade, in which he reminded African Americans of that horrific time when he stated
'In the first 100 years of the Republic, the States enacted numerous laws restricting the immigration of certain classes of aliens, including convicted criminals, indigents, persons with contagious diseases, and (in Southern States) freed blacks. State laws not only provided for the removal of unwanted immigrants but also imposed penalties on unlawfully present aliens and those who aided their immigration.’
The Supreme Court is the highest court in the United States. The Justices are appointed by the President and confirmed by the Senate. Once appointed, justices have life tenure unless they resign, retire, or are removed after impeachment. For this reason, Justices should uphold the Constitution (in its entirety) in their dissent or agreement with the courts decisions.
