Student safety in schools needs to be guaranteed
The Issue
It is mandatory for parents to send their children off to school for a set number of years. It is expected that student's physical, mental and emotional well being will be looked after during the roughly 180 days a year that students are away from their families and being taught.
However, according to the recent case dismissal of Mohat v. Mentor, "although parents should expect that their children will be kept reasonably safe when under the school's supervision, the school had no constitutional duty to take affirmative action to protect [a student] from harm imposed by other students though bullying and emotional and physical harassment" because students are not in a "special relationship" with the school. Student and teacher are not consitered a "special relationship" and as this student physical, mental and emtional health are not guaranteed.
It is understood that teachers are busy, and are expected to watch a large number of students at a time, but it should be mandatory that the person who is in charge of our students when they are at school have a legal responsibility to protect these children from bullying and harassment from their peers.
