Parents and educators have been saying for years that the NYC Department of Education (NYCDOE) is setting up schools to fail so they can close them and replace them with small schools and charter schools. We argued that the NYCDOE purposely undermined schools by not providing the resources, increasing class sizes and overcrowding the schools with high needs populations such as English Language Learners, Special Needs students and struggling students. The recently released Parthenon Group report proves the DoE's purposeful malfeasance and educational neglect. The Parthenon report shows the NYCDOE knew their strategy would cause those schools to have low graduation rates and not provide an equal educational opportunity or free and appropriate education to ALL students. I am writing this letter to formally request that your office conduct an investigation into the violation of NYC students' civil rights by the NYC Department of Education (NYCDOE). The children of NYC are not receiving a Free and Appropriate Public Education from the NYCDOE.

The NYCDOE has violated NYS Education Law 2590-h, which creates a duty for the Chancellor to promote an equal educational opportunity for ALL students in the schools of the city district and to foster educational equity.
Again, I am formally requesting your respective offices investigate the NYCDOE's violations of our children's civil rights.
