I was a stay at home mom, and gave birth to three beautiful children, Aislinn, now age 5, Kristin, now age 4, and JB, now age three. My ex husband worked outside of the home and traveled often. There was also occasional domestic abuse in our marriage. The police were called a few times, and my husband always told the authorities that I started the dispute. After the police started to believe him, I could not call the police anymore for help. So, I tried to pretend as if everything was normal, and just waited until he left for work everyday. My children were my life. I had been a teacher previously, and it was my dream to homeschool the children. I baptized the children Catholic, and tried to raise my children, while fending off my husband's abuse in the evenings. When my son was 6 months old, my husband left for a month at Christmas time. He came back, and then left 8 months later for good. He left me with the house and kids, and I could not have been more happy. Until he filed for custody, and I had to give the kids to him every other weekend and Wednesday evenings from 5-7 p.m. I then got a lawyer, and filed for child custody myself. When we went to court, he requested a GAL. I was given primary physical custody, and we had joint custody. Giving the children to him every other weekend was hard because the children screamed and cried that they did not want to go with Daddy. Six months after the GAL was assigned, my husband show caused me for obstructing visitation, and told the GAL I had mental issues and could not take care of the children. The GAL then increased my husband's time with the children to every other weekend, and Wednesdays from 5 pm to 8am on Thursday morning. The GAL then instructed my husband to move to a 2 bedroom apartment instead of a 1 bed room apartment. I was living in our 4 bedroom house with the children. On the first midweek overnight, my oldest daughter, Aislinn, who was 4 at the time, told me her Daddy was touching her private area with a stick. I called the police, got an emergency protective order, and contacted CPS. Aislinn had a forensic exam, a videographed interview, and the CPS investigation came back as an unfounded sexual abuse allegation. Her father's visitation resumed, and then they started to tell me that I was a liar, and that I was poisoning the children against their father. Six months later, my husband was awarded sole physical and legal custody of all three children, he enrolled them in a daycare center, and gave me visitation of wednesdays from 4-7 p.m. and every other weekend, and gave me 30 days to vacate the home. I am not employed, and accumulated almost $20,000 in credit card debt after he left, so I thought I was going to be homeless. I petitioned the court to rehear the issues, and the judge refused. I was able to get a 1 bedroom apartment after filing a claim on my engagement ring and surrendering it to the insurance company. My 4 year old Kristin is now saying her Daddy is touching her. Daddy also has a girlfriend who the children say kisses Daddy all the time. She often spends the night. I am not even allowed to talk with my children by phone. I appealed the custody decision and it was affirmed in the Circuit Court, and most of my testimony was determined to be incredible. They would not believe me that the children were sexually abused, or that I was physically abused. They would not even look at the pictures of the bruises or admit into evidence the medical reports from my OB of the physical abuse that occured while I was pregnant with my thirs child. They just wanted to proceed as if it was a no-fault divorce, with no complications. In the final divorce, my husband was awarded with the house, physical and legal custody of the three children, sole legal custody of all the bank accounts and assets. I was awarded my car, and that's it. I had to put all of my children's childhood belongings, furniture, toys and possessions into a storage unit because I can't fit it all into a 1 bedroom apartment. In the last 9 months that the children have been living with their father, they have been seen by doctors 10 times each in the past 9 months. Currently, they all have respiratory infections that cannot be cured by antibiotics. They are dispirited, sad and depressed all the time. I can go to their preschool to see them, but even the preschool personnel will only allow me to be there at certain times. I have appealed the Circuit Court decision in the Virginia Court of Appeals, and while I am waiting for its review, my husbands attorney and the GAL have issued several show causes of contempt of court on me for not signing over the deed for the house, and not paying child support. I have no job and income, and have no means to pay child support. I was also ordered to pay my husband's attorney fees. I fear for the survival of my children. They are so sick now, and their spirits are just about drained. It is as iff they don't have the will to fight anymore, because no one listened to them when they were fighting. I need your help. Please sign this petition to help me get custody of my children back, and my home.
