The Issue
“WE THE PEOPLE”
The primary intent of this petition is to tell the elected powers in Washington D.C. that your rights have not been protected by your participation in the US legal system.
There are still many Americans who still are under the Illusion that we live in a free country and that the US legal system is fair, impartial and actually enforce the laws designed to protect the rights of the more vulnerable members of our society. (e.g., the 99%, the elderly and the disabled) I can tell you from our personal experience being the victims of illegal preceding that if you cannot afford a lawyer who is not connected to the “dark side” of the US justice system. (i.e., lawyers/judges who focus on racking up legal fees for themselves and their colleagues, while they do not ensure that the rule of Due Process is adhered to in their courtrooms) a person can end up having a very unpleasant experience at the expense of the officers of the court who do not have their client’s best interests at heart.
In the United States, the generic term officer of the court (not to be confused with court officers) is applied to all those who, in some degree in function of their professional or similar qualifications, have a legal part—and hence legal and deontological obligations—in the complex functioning of the judicial system as a whole, in order to forge justice out of the application of the law and the simultaneous pursuit of the legitimate interests of all parties and the general good of society. The section that is underlined expresses how the legal system should ideally function- namely that it is a system that should strive to improve both the legitimate interests of all parties-and the general good of society. When lawyers and judges have “closed-door” meetings without the clients present to set legal fees, then neither the application of law nor the objective of being an agent of general good for our society are achieved.

This quote describes the philosophical basis of the 1948 Declaration of Human Rights which the United States along with many other countries agreed to.
“the right to an effective judicial remedy; freedom from arbitrary arrest, detention or exile; the right to a fair trial and public hearing by an independent and impartial tribunal; the right to be presumed innocent until proved guilty; freedom from arbitrary interference with privacy, family, home or correspondence; freedom of movement and residence; the right of asylum; the right to a nationality; the right to marry and to found a family; the right to own property; freedom of thought, conscience and religion; freedom of opinion and expression; the right to peaceful assembly and association; and the right to take part in the government of one's country and to equal access to public service in one's country.”
These are specific rights of the 1948 Declaration that have to do with either a legal right or a civil right that would be denied if the legal right was denied –for example there are a number of civil rights which are denied if a person is not granted a fair trial and public hearing by an independent and impartial tribunal, or imagine the civil rights which are denied if a person is not granted the right to an effective judicial remedy.
There is a certain dependency between the denial of a person’s specific legal rights and the corresponding civil rights which are lost as a result. The point is in the relationship between the denial of a person legal rights and how it impacts their civil rights is to make it crystal clear that the people living in the United States will not have the majority of their civil rights intact if the legal system and the rights which this system provides to the average American is compromised.

Article 3-Universal declaration of Human Rights adopted by General Assembly resolution 217A (III) as of 10 December 1948
In accordance with the Universal Declaration of Human Rights, the ideal of free human beings enjoying freedom from fear and want can only be achieved if conditions are created whereby everyone may enjoy his economic, social and cultural rights, as well as his civil and political rights.
One of the most basic conditions that we as Americans must have in order to ensure a free society is that of an impartial judiciary system that protects the individual rights of the citizens who participate in the system to seek justice. Again, if Americans legal rights are not being protected then there are corresponding civil rights which are lost, and a number of powerfully painful results- from being denied the right to own property, to paying excessive legal fees, to not being able to vote can occur.
It is very difficult to feel that you are a free American, if your basic legal rights were not protected by the officers of the court. (i.e., Lawyers, Judges, etc., etc.) Even though we still love this country-we no longer feel that we are free Americans! (It makes us very angry!!)
“Educate and inform the whole mass of the people... They are the only sure reliance for the preservation of our liberty”.
This petition is not a public forum to debate the outcome of a civil or criminal proceeding (or the associated legal fees), but is designed to begin the process of raising the awareness of the people in power that there are many Americans who feel that their fundamental legal rights-as defined by the amendments to the US constitution (i.e. 4th, 7th & 14th amendments primarily) were not protected by various participants in the US legal system. Just like the Boston Tea Party rallied its members with the battle cry-“Taxation without representation”, our group’s objective is to increase the visibility of this issue of strengthening the protection of the legal rights of our fellow Americans!
We want to strengthen the representation of those being taxed by our government whose rights at both the state and federal levels are supposed to be protected!! For many Americans our country is not protecting the basic legal rights of Americans participating in our legal system.
In order for the critical mass required for the objective of this petition to be met (we need every person in America who has ever felt that their legal rights were not protected) during a legal proceeding to sign this petition-!!!
Your vote really does count-especially with respect to protecting your basic legal and civil rights!
This is not a zero-sum game were gains in strengthening your rights come at the cost of someone else’s rights.
We need to stick together and protect the rights of all Americans to ensure the integrity of the US legal system!!

It is the duty of “WE” the People to be watchful of the actions of our elected Government Officers, so that they will not become lawbreakers, but they will abide by their duty to protect the Constitutional Rights of the People and void any stealthy encroachments that violate these Rights.
