Petition to Commute the Death Sentence of Darryl Durr

The Issue

Darryl Durr was convicted of the 1988 murder of Angel Vincent and sentenced to death.  Trial counsel was ineffective for failing to:

            -Interview members of his family and obtaining a social history

            -Object to portions of the State’s closing argument

            -Object to allegedly improper jury instructions

            -Obtain experts for mitigation

The trial counsel man stated because the court would not cover the costs for a pathologist, criminalist, psychologist, or mitigation specialist, they didn’t attempt to get any sort of expert where a psychologist would have provided the jury with mitigation evidence.
