The Issue

The prosecutor plead him to 3rd degree, labeling him NON-VIOLENT, after he attempted to rape Peggy Kandies, as he tried to hold her down she fought for her life, he bit her mouth and butted her head. This is violent and they should of prosecuted this man to the fullest.

BERKELEY COUNTY, SC (WCSC) -

A woman who was beaten while fighting off a would-be rapist is fighting again to keep her attacker behind bars.

Peggy Kandies was staying at a friend's trailer at the Sunrise Mobile Home Park on Red Bank Road when the man who lived next door targeted her. Kandies said she had no warning when 30-year-old Frederico Reyes burst through the door.

"He literally jumped on me when he came through the door," Kandies recalled. "He physically tried to rape me and while he was on top of me, he bit my mouth."

Kandies used Ju Jitsu to fight back, and Reyes fled. He was caught quickly. Reyes pleaded guilty to assault with intent to commit criminal sexual conduct in the third degree and got five years in prison.

Under state law, his offense is considered non-violent, which makes Reyes eligible for parole on September 14.

Kandies plans to be there and will fight to keep her attacker in prison for at least another year.

Reyes, an illegal alien, is scheduled to be released from prison in Dec. 2012. When he completes his sentence it will be up to Immigration Customs Enforcement to decide if he should be deported.
