ICE Prosecutor Margaret Curry: Stop the Deportation of Fernando Diaz

The Issue

A 22 year-old native of Petaluma, CA is now living on borrowed time as he faces deportation. A graduate of Petaluma High School Fernando Diaz has been in the U.S. since the age of 6. Having married his high school sweet heart a year ago has done little to help his case as Fernando now fights to stay in the U.S. to better provide for his family.

In January of 2010 Fernando was picked up by Petaluma Police in connection to an auto theft, though, as later evidence would prove, he was completely unconnected to the crime. However, his finger prints were entered into ICE's national database and placed into deportation procedures. Now, he faces deportation to Mexico where he has no immediate relatives. Fernando would also be leaving behind a wife who is an American citizen.  He has proven himself with family and friends to be a trustworthy and honest family man that has continued to contribute to his community.

Janet Napolitano, the Secretary of Homeland Security under which the office of Immigration and Customs Enforcement falls under, "At a hearing of the Senate Judiciary Committee on May 6, 2009, testified 'the DREAM Act is a good piece of legislation and a good idea.'  We greatly appreciate her support for the DREAM Act. 

John Morton, the ICE Director, penned an important notice known as the Morton Memo on Prosecutorial Discretion.  In it, Morton writes that those of low-risk and priority such as DREAMers (undocumented youth eligible for the DREAM Act) would not be targeted nor the focus of ICE and would be an important factor to exercise prosecutorial discretion.

We ask that ICE Prosecutor Margaret Curry take into serious consideration all of the above factors and help keep a family and community together by stopping the deportation of Fernando Diaz and grant him deferred action.
