Because he has always had proof of his innocence with a declaration from a witness naming the murderers. The witness put the statement in the police report 21 years ago, yet his attorney was incompentant and never called the witness in. 21 years later the same witness just wrote the same statement in a declaration after we hired an investegator to meet with the witness.
