Regulate Insurance Companies

The Issue

Thousands of U.S. workers have been wrongfully denied the private disability insurance coverage their middle-class jobs supposedly afforded them. Among them are injured workers who have had to battle improper denials at the same time that they struggled with health problems and the financial strain they had sought to avoid. We call for regulation and access to justice. Because federal law does not allow people to sue for anything except the original benefits - no damages or pain and suffering that lead to big victories - many plaintiffs' lawyers say they refuse to take ERISA cases. As a result, those few brave souls who are willing to fight may not be able to find an attorney. Appeals are routinely denied and Doctors hired by the insurance companies take the insurance company's side without ever seeing the patient and in direct contradiction of the attending physician's recommendations. These insurance companies continue to bring in record profits while the disabled who have paid into their insurance for multiple years expecting a "safety net" if they fall sick or injured end up being denied benefits, or having benefits terminated and sometimes even sued for payments received. We need someone to advocate for the sick, injured and disabled who rightfully are due these disability payments, and some sort of recourse for those of us who have been denied or had payments terminated without good cause.  The insurance companies continue "business as usual" with virtually no downside to the practice of regularly and wrongfully denying claims to those who need them most.
