Commute the Death Sentence of Roderick Davie

Commute the Death Sentence of Roderick Davie

The Issue

Roderick Davie (a.k.a. Abdul Hakiym Zakiy) was convicted of the 1991 murders of John Ira Coleman and Tracey Jefferys.  Davie’s case requires suppression because the police persisted not only after a refusal to sign, but also because they persisted even after Davie expressly invoked his right to silence by refusal to talk.  In his dissent, Judge Gilbert Merritt wrote that Davie was illegally enticed to confess despite repeated refusals to waive his Miranda rights.

The state of Ohio plans to execute Roderick Davie (a.k.a. Abdul Hakiym Zakiy) on August 10, 2010.
