Cheney should be prosecuted now

The Issue

Repeatedly, Attorney General Holder and President Obama have said waterboarding is a felony, yet, former Vice President Cheney boasted on ABC's This Week, in the past, "I was a big supporter of waterboarding."   Torturing or conspiring to torture is a criminal offense under Section 2340A of the Federal Criminal Code; and a clear violation of all international legal norms and human rights.  Given that CIA agents have confirmed that waterboarding was used only after National Security Council clearance, and Mr. Cheney has admitted to using his position within the NSC to advocate the use of waterboarding and other "techniques," why hasn't the former Vice President been charged?  Cheney has admitted being involved in waterboarding decisions in at least three cases. He should be indicted and tried in the civil courts, at minimum, now.
