Stop all commercial uses at Kailua Beach Park not considered by 1996 EA

The Issue

The City and County of Honolulu is in violation of HRS § 343 with regards to allowing commercial uses at Kailua Beach Park. The City needs to stop all commercial uses at Kailua Beach Park not considered by the 1996 Environmental Assessment for Kailua Beach Park. According to the Final Environmental Assessment for the Revised Master Plan for Kailua Beach Park conducted in 1996, windsurfing was the only commercial use considered.

Some of the unauthorized commercial uses currently operating at Kailua Beach Park without environmental assessment consideration are:

• Tour bus and (commercial tour vehicle) stops
• Kayak rentals, drop offs, lessons, and tours
• Kiteboarding rentals, lessons, and tours
• Stand up paddle boarding rentals, lessons, and tours

These unauthorized commercial uses must cease from operating at Kailua Beach Park immediately. The public demands compliance with existing laws. Non-compliance will be cause to seek legal action.

Furthermore, the Mayor and City Council should fully support Bill 11 CD1.  Bill 11 CD1 will ban commercial use at Kailua Beach Park thereby ensuring compliance with the 1996 Environmental Assessment for Kailua Beach Park and satisfying the will of the people.
