Anonymity For the Accused
The Issue
According to the 5th Amendment of the U.S. Constitution, the accused are not to have their unalienable rights of life, liberty, and the pursuit of happiness denied them until due process.
Unfortunately, most of the people, especially the media, and employers, have forgotten that Amendment.
Being accused and/or arrested of a crime is nowhere close to being convicted of a crime. However, if you are one of the unfortunate people that are falsely accused and/or arrested for something, you might as well be convicted.
After a couple of deranged teenagers thought it would be funny to brag about having a party at my house and having sex with me, I lost my job as an educator of thirteen years. An overzealous new Chief of Police who thought this was his first "big case" decided to get his name on television by arresting me with nothing more than a couple of written statements by these kids. I was immediately put on Administrative Leave and my mug shot was on several television stations and newspapers that night. Two months later, the stories got even bigger when one of the girls said that I not only served her alcohol, I raped her. Again, I was arrested and my mug shot was all over the news.
After moving two states away to avoid being harassed by the police department and to just get away from everything, I obtained a job at a college as an adjunct instructor. Again, I was doing what I loved to do; teaching.
However, after two weeks in class, I was fired from that job. The college wouldn't give me an explanation as to why they were firing me, they just said, "We think it would be in the best interest of the students." I'm sure all they did was Googled my name and saw all the one-sided news stories and my mug shots.
Meanwhile, back in the small town in Texas, the District Attorney has still not even received the file on my case, and it has been almost five months since the first arrest. The case will probably never go to court, but I am already spending a life sentence just because I was arrested.
Before this happened, I thought when people got arrested it was because the police had enough evidence to make a case. That is not true. According to my attorney, if anybody makes a statement about you, they can arrest you based solely on that statement.
Once you are accused of a crime of this magnitude, even if the accusers come back and say that they were lying, your life is never the same. Their life goes on and nobody ever knows who lied to the police because their names are never released!
My life has been turned upside down and will never be the same again because of these horrible allegations. I believe that God allows things to happen for a reason though; and I believe that reason is because he knew that I will do something about it. The 5th Amendment needs to be upheld for the citizens of this great country, especially the accused. The accused should have the same rights as the accuser!
Why do we have the 5th Amendment if we don't enforce it?
If the accused remains anonymous, then when they are found not-guilty, or the case is dismissed, their lives are not effected; other than the thousands of dollars they have to spend in lawyers fees.
Please sign the petition to protect ALL U.S. citizens, not just the accusers.
