Allow development of Sol Contingency project

The Issue

Dear Interplay,

A few days ago, whole Descent fan community was struck by the sad news of Cease and Desist notice regarding the fan-driven Sol Contingency project.

Our community grew around one of the most recognizable (not to say, iconic) video games of all times - the Descent series. Developed initially by Parallax Software and Interplay Productions the game become very popular by introducing a brand new 6-degree-of-freedom way of playing and - despite limited resources provided by past computers - successfully creating creepy, claustrophobic feeling of underground caverns, which is enjoyable even today. Suffice to say, Descent is one of the oldest games, which are still being sold - 2014 marks twentieth year of Descent's existence in the players community.

Since Interplay did not informed about any developments leading to creation of a remake or sequel of this popular game and since today's technology allows starting such project, the fan community gathered to create their own remake of this game.

Please note the following facts.

- Sol Contingency is created by people in their spare time. While based on Descent, this project was never commercial and neither the developers nor other people involved were paid for their effort.

- The developers - despite repeated requests from the community - refused to put their project on Kickstarter to raise funds for its development.

- The developers never challenged Interplay's copyrights to assets being used in the game - model or level designs, sounds, music and so on. These elements were used as a fan tribute to Descent.

- Every asset used in Sol Contingency was created by the developers from scratch. No original Descent assets were put in the game. Many of the new assets look or sound at least slightly different from Descent.

Knowing that, we, the Descent community ask for the following:

- To allow continuing a fan project, which in its essence is actually a tribute to Interplay's legacy, thus allowing Interplay's fan community to grow.

- To grant the Sol Contingency developers rights to use the designs and names from the original game such that the project may be continued in unchanged form.

And, to either:

a) provide us with information on how to clearly state that Interplay owns the copyrights of designs used in the project (for instance, a splash screen in the final product),

or:

b) to negotiate a license and business plan to develop Sol Contingency into an official product based on Descent, with profits going to Interplay and the developers.

We all hope for Interplay's support in our community.
