Against the backdrop of the assaults on unions happening in many statehouses across the country, a little-noticed provision of the Federal Aviation Administration Reauthorization bill moving through Congress represents a similarly shameless attack on unions.

Some Members of Congress are trying to adopt a standard for airline and railroad elections to count eligible voters who did not participate in the election the same as actually having voted “no” in the election. Counting non-voters as “no” voters is a flagrant violation of fair election standards and would stack the decks against unions. If Members of Congress were held to this standard none of them would have won their elections in 2010.
