AMEND HB00113 THE PHILIPPINE IMMIGRATION ACT OF 2010

The Issue

Immigration is one of the top three corrupt agencies in the Philippines.  They arrest foreigners on minor visa violations and lock them up in their detention jail for months and years until they are so desperate that they will pay any amount to be deported. These practices are not only against the law but also bad for tourism, foreign investments and job growth. We need congress to investigate these crimes and make sure the proposed new immigration law eradicates such practices.   

PETITION TO AID LEGISLATION IN THE AMENDING OF HB00113

THE PHILIPPINE IMMIGRATION ACT OF 2010 CALLING FOR A CONGRESSIONAL INQUIRY INTO CURRENT PRACTICES OF THE BUREUAU OF IMMIGRATION IN PARTICULAR RELATION TO :

 

1. HUMAN RIGHTS ABUSES TO ENSURE THE NEW ACT WILL CONTAIN PROVISIONS WHICH REAFFIRM THE ACTS COMMITMENT TO PHILIPPINE GOVERNMENTS RATIFICATION OF UNITED NATIONS CONVENTIONS ON HUMAN RIGHTS, RIGHTS OF THE FAMILY AND THE CHILD AND PROVISIONS ERADICATING ARBITRARY DETENTION.

 

2. ENSHRINING THE CONSTITUTIONAL RIGHT TO BAIL AND REMOVING ANY DISCRETION ON THE ISSUANCE OF BAIL BY PROVIDING PROVISIONS AND SPECIFIC CRITERIA FOR WHEN A DETAINEE CAN OR CAN NOT BE RELEASED ON BAIL.

 

3. INSERTION OF STRICT PROVISIONS AND PENALTIES WHERE THE BOARD OF COMMISIONERS CAN NOT USE MEMORANDUM ORDERS TO CREATE QUASI LAWS AND USURP THE POWER OF CONGRESS IN LAW MAKING AS THE CURRENT PRACTICE OF THE BUREAU IS.
