Disqualify Rahul Gandhi as a candidate for Member of Parliament from Amethi, Lok Sabha Elections 2014

The Issue

Rahul Gandhi is the leader of the oldest political party of India, Indian National Congress (INC). He should lead by example and must respect and abide by the rule of law.

As per Section 126 (2) from the chapter I Corrupt Practices of People's Representation Act of India, 

"Undue influence, that is to say, any direct or indirect interference or attempt to interfere on the part of the candidate or his agent, or of any other person [with the consent of the candidate or his election agent], with the free exercise of any electoral right"

As per Section 96 

"Secrecy of voting not to be infringed.—No witness or other person shall be required to state for whom he has voted for election"

Please see the above picture taken at Amethi's Madhyamik Vidyalaya Phoola in Tiloi assembly segment at 10.24am on May 7th courtesy Times of India. Mr. Rahul Gandhi, is directly influencing and interfering with the free excercise of electoral right of the voter casting his vote at a polling booth in Amethi. As per law, only three people can access the voting compartment: the voter, presiding officer and polling officer during the polling hours. Please note that Rahul Gandhi is not a registered voter of Amethi. So he has no purpose to be anywhere near the Electronic Voting Machine duirng the polling hours. A plausible reason is that he is there to influence the vote count or voter. 

Therefore, as per the second statutory disqualification contained in section 8-A of the Representation of the People Act, Mr. Rahul Gandhi must be disqualified for a corrupt practice at an election.

Additionally, several other complaints with photograph evidence of Rahul Gandhi entering the polling machine area were also filled during the voting perioed.

Also complaints of rigging and booth capturing by INC at many booths in Amethi was filled at the following booths -

Jagdishpur 4 booths 108, 109, 110, 111 
Amethi Vidhan sabha Booth No 41, 42 

This petition had 5,043 supporters
