The Issue

India's Supreme Court makes the gay sex punishable offence, again. Parliament is authorised to remove Section 377.

The Supreme Court of India on Wednesday ruled that gay sex is a criminal offence, dealing a severe blow to the largely-closeted homosexual community in India. 

The top Court said the 2009 Delhi High court order decriminalising homosexuality is constitutionally unsustainable as only Parliament can change a law.

While hearing the appeal, the apex court had pulled up the Centre for its "casual" approach on decriminalisation of homosexuality and also expressed concern over the Parliament not discussing such important issues.

"It is for the legislature to look into the desirability of deleting section 377 of the IPC," the apex court said.

Section 377 of the IPC makes homosexual acts a criminal offence, entailing punishment up to a life term.

The government is doing a flip flop. But lots of top politicians, ministers, media houses and film personalities are coming out in support of LGBT. But the Government is avoiding taking any decision. That is why we all should request Indian parliament.

India is the largest democracy in the world. But after today’s verdict, I doubt. This is against human rights.  LGBT community just wants equal rights, decriminalisation, and dignity. It is bringing India back to the list of medieval homophobic countries. 

It is very sad to see how gay people are treated in India and forced to marry against their wish. Their sexual preferences have never been given importance and it affects their lives as well. I want people to support LGBT community of India in this fight against Homophobic mentality and raise awareness about gay people, their sexual preferences being given priorities and personal choices and how they can be prevented from being social victims. There is a lot of ignorance regarding the community which still thinks homosexuality as a disease. 

Section 377 against Love and Humanity. They are not criminal, they are peace loving people. This judgement will lead to police brutality, blackmail, threat. etc.
