DOGS ARE FAMILY, It’s time our laws catch up: Companion Animal Law Reform

The Issue

When your dog or cat is stolen ——- the official advice from nearly every reputable source  —— is the SAME: 👉    1.     Make a Police Report       2.    Take Advantage of Social Media

🐾  THE BROKEN SYSTEM VICTIMS FACE TODAY: Yet none of these recommendations address what commonly happens when:

  • Police decline to act, calling it a civil matter because pets are “property”;
  • The rightful owner is told to go to civil court — a process that can take years;
  • And any effort to raise awareness — through social media, flyers, or local news — is later twisted into claims of harassment or defamation by the person withholding the pet.

——-> Families are left powerlesssilenced for simply trying to bring their loved one home.

 

 

⚖️ THE LEGAL GAP:

Under current U.S. law —- dogs and cats are classified as personal property - valued for their cost when adopted,  creating a procedural loophole that harms both pets and families:

  • Police often refuse to investigate or file criminal charges in “custody disputes”.
  • Victims must resort to civil litigation — filing replevin or conversion actions — (lawsuits to recover wrongfully held property).
  • Even when ownership is clear, delays and costs leave pets in limbo for years, often suffering neglect or emotional trauma.

 

💔 WHY THIS MUST CHANGE: Victims of pet theft are left in an impossible position:                                                                                                                                                      

  1. They are told by police that “it’s a civil matter,”
  2. told by civil courts that “it’s property,” and
  3. told by society to “use social media” — only to be punished for doing exactly that.

Without reform, every family wrongfully separated from their beloved dog or companion animal through theft or deceitful acts—- face the same heartbreaking and unjust pattern:

          ❌ No criminal accountability.

          ❌ No swift return of their pet.

          ❌ No legal protection when they speak out.

 

🌟 SIGNS OF PROGRESS: THE LAW IS BEGINNING TO CHANGE:

 

There is hope. Courts are beginning to recognize that companion animals are not mere property — they are family.

  • In DeBlase v. Hill (N.Y. Sup. Ct. 2025), —- a groundbreaking case, the court recognized a dog as an immediate family member, applying equitable principles to determine ownership and custody. The judge emphasized that decisions involving companion animals must reflect their emotional significance and sentient nature, not simply their monetary value.

  • In Houseman v. Dare (N.J. App. Div. 2009), the court acknowledged that a dog’s unique value cannot be measured in dollars and cents. The ruling affirmed that pets occupy a special status under the law, and that fairness and compassion — not rigid property doctrines — should guide judicial decisions.

These decisions mark a major shift — one that aligns with growing public understanding that our pets hold a place in our lives unlike any object. Together, these cases demonstrate a growing momentum towards reform —-  A recognition that pets are not things to be divided or owned, but living beings deserving of justice and dignity.
